THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA

SUBJECT: Hearing on Certification of Environmental Impact Report,
Draft General Plan Amendment ( 2-91-SR) , Draft Dougherty
Valley Specific Plan ( 2-92-SP) , Rezoning Application .
2993-RZ, Shapell Industries (applicant and owner) , and
Rezoning Application 2992-RZ, Windemere Ranch Partners
(applicant and owner) in the Dougherty Valley Area.
This is the time heretofore noticed by the Clerk of the
Board of Supervisors for hearing on the recommendation of the
Zoning Administrator on the certification of the Environmental
Impact Report and the recommendation of the Contra Costa County
Planning Commission on the Draft General Plan Amendment for a 6,000
acre area within the unincorporated area of Contra Costa County
located to the east of the City of San Ramon in the Dougherty
Valley on both sides of Dougherty Valley Road generally south of
Crow Canyon Road to the Alameda County Boundary. The plan
amendment affects all mandatory elements of the adopted general
plan and calls for a range of residential densities and up to
11,000 dwelling units, commercial areas and substantial open space;
Draft Dougherty Valley Specific Plan ( 2-91-SR) which provides
detail and added development requirements to further implement the
proposed Dougherty Valley General Plan Amendment; application
( 2993-RZ) by Shapell Industries (applicant and owner) for approval
of a rezoning with a Preliminary Development Plan approval for
approximately 2,708 acres from Agricultural District (A-80) to
Planned Unit Development (P-1 ) to construct up to 5, 830 residential
units. The project . further incorporates 1,386 acres of open space
and park and recreation facilities, 26 acres of non-residential
uses and 38 acres as public/semi-public uses; application ( 2992-RZ)
by Windemere Ranch Partners (applicant and owner) for approval of a
rezoning with a Preliminary Development Plan for approximately
2 ,416 acres from Agricultural District (A-80) to Planned Unit
Development (P-1) to construct up to 5 , 170 residential units. The
project further incorporates 1,145 acres of open space and park and
recreation facilities, 22 acres of non-residential uses and 98
acres of public/semi-public uses in the Dougherty Valley area.
James Cutler, Community Development Department,
presented the staff report on the actions before the Board and the
Planning Commissions ' actions, and he commented on the Zoning
Administrator ' s recommendation that the Environmental Impact Report
be certified as adequate for County purposes, and he advised that
the Board needed to take action to certify the Environmental Impact
Report. Mr. Cutler described the General Plan Amendment, the
Specific Plan Amendment, rezoning applications and preliminary
development plans 2992-RZ and 2993-RZ, and he also commented on the
pending consideration of Development Agreements on this matter. He
also commented on the California Environmental Quality Act findings
and the mitigation and monitoring program which will be tied to the
CEQA findings and the direction to staff to file a' Notice of
Determination.
The following persons appeared to speak:
Tom Koch, representing Shapell Industries, spoke in
favor of the requests before the Board, presented a brief history
of the project, described benefits of the proposed project, and
presented a brief overview of the project.
Darryl Foreman, Bishop Ranch, San Ramon, representing
Windemere Ranch Partners, spoke in favor of the proposed project.
Joan Buchanan, 19 Mott Drive, San Ramon, representing
the San Ramon Valley Unified School District, commented on work
that had been done on a plan to provide adequate schools for
students in the Dougherty Valley.
Patricia Boom, Mayor, City of San Ramon, 2222 Camino
Ramon, San Ramon, summarized the contents of a letter from the City
of San Ramon (Copy not presented to the Clerk) and commented on
issues including not rushing the planning process, affordable
housing units and credit for affordable housing units, and
development of housing for the disabled in Dougherty Valley. Mayor
Boom requested the inclusion of various policies relative to
infrastructure, financing, fiscal and financial monitoring program,
limiting development in the Dougherty Valley on a per year basis,
phasing, open space, trail linkage, public services, traffic, a
mitigation monitoring program, and inclusion of the results of the
Dougherty Valley Roundtable discussions.
Beverly Lane, Mayor, Town of Danville, spoke on past and
present uses of land in the Dougherty Valley, and she spoke on the
position of the Town of Danville that the Dougherty Valley is an
appropriate area for some level of growth, that the Dougherty
Valley Specific Plan is not specific enough, that the Dougherty
Valley proposal is not a self-contained community, and she
commented on things that the Town of Danville would expect. Mayor
Lane also commented on the complexity of the project, on the
mitigation matrix, and on the speed of the process.
Millie Greenberg, Council person, Town of Danville,
advised the Board of the Town of Danville' s objection to the
proposed certification of the Environmental Impact Report as
adequate and complete and she requested recirculation of a revised
Final Environmental Impact Report. Ms. Greenberg commented
particularly on the issue of traffic.
William Corey, 500 Court Street, Martinez, representing
Contra Costa Community College, read a letter dated December 8,
1992 from the Contra Costa Community College District objecting to
the removal of a college site from the General Plan Amendment and
the Environmental Impact Report.
Evelyn Munn, 35 Sandra Court, Walnut Creek, representing
TRANSPAC, commented on a letter dated November 25, 1992 from
TRANSPAC relative to violations of the law and intent of Measure C.
Martin Vitz, 2950 Peralta Oaks Court, Oakland,
representing East Bay Regional Park District, presented a letter
dated December 4, 1992 expressing specific district concerns.
The Chair advised that Supervisor-elect Gayle Bishop had
submitted a letter requesting that this item be continued to a time
when the newly elected members of the Board have an opportunity to
participate in the deliberations.
The Board discussed the continuation of the matter to
December 15, 1992.
IT IS BY THE BOARD ORDERED that the hearing on the above
matters is CONTINUED to December 15, 1992 at 2 : 00 p.m. and 7: 00
p.m. in the Board Chambers.
