MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: December 8, 1992 SUBJECT: COLLECT AND CONVEY DRAINAGE REQUIREMENTS FOR MINOR SUBDIVISION 45-91 (RENNACKER - WEST PITTSBURG AREA). SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: 1. ACCEPT this report regarding a request from Ms. Myra Rennacker for relief from the "collect and convey" requirement on Minor Subdivision No. 45-91. 2. APPROVE the following as an alternative condition of approval to the "collect and convey" requirement of Ordinance Code Section No. 914-2.00: a. All drainage to and from the site shall be conveyed across said site in an adequate, maintainable, open drainage way to the existing roadside ditch. b. Developer shall execute a recordable agreement accepting unto himself and future owners of the above drainage way all responsibility for future maintenance and liability. C. Developer shall be required to pay a drainage deficiency fee in order to mitigate the accumulative hydrology impact from this development. The drainage deficiency fee amount, based upon $1.00 per square foot of impervious surface generated by his development, is calculated to be $10,215. ADOPT the following findings pursuant to Chapter 92-6, "Exceptions", of the Ordinance Code in order to approve the alternative condition of approval: a. There are unusual circumstances or conditions affecting the property. Extensive drainage improvements are necessary and most of the area has developed, thereby eliminating the opportunity for a joint development drainage project. The potential for land development activity to provide for orderly development of the drainage system is unlikely in the near future. b. The exception is necessary for the preservation and enjoyment of a substantial property right of the applicant. Subdivision of land in the general West Pittsburg area needs to occur by allowing developers to comply with the Drainage Division of the Subdivision Ordinance with improvements which are much less extensive per unit than those required for this development. C. The granting of the exception will not be materially detrimental to the public welfare or injuries to other property in the territory in which the property is situated. The amount of storm water runoff from the new impervious surfaces, approximately 10,215 square feet, is minor in comparison to the size of the watershed. II. Financial Impact: The financial impact to the County is unknown. III. Reasons for Recommendations and Background: The one acre in the Bella Vista Avenue area of West Pittsburg contains two existing single -family homes. Ms. Rennacker wants to subdivide this site into four equal parcels, with two of the parcels to be created being vacant and the other two being occupied by the existing home. Unfortunately, drainage in this area depends on inadequate road side ditches to convey surface runoff. The nearest adequate drainage facility is located approximately 1,800 feet away. We have had several engineers review this development to determine the least costly drainage solution that meets the requirements of "collect and convey". They have concluded that all of the potential solutions are not economically feasible for a minor subdivision. A strict compliance to the"collect and convey"requirement places a hardship on Ms. Rennacker. There exists an unusual circumstance where as it would be impossible for Ms. Rennacker to generate the necessary funding from a minor subdivision needed to design or construct any drainage improvement that would have a significant impact in this area. Staff recommends that the Board permit the alternative condition of approval in lieu of full "collect and convey". The proposed contributions to regional drainage from this development represents its fair share of the future costs. The cash contribution will be pooled with other monies to implement needed drainage improvements to service this area. IV. Consequences of Negative Action: Full requirements of "collect and convey" would place a financial hardship on this development and most likely cause it to be not feasible. cc: County Administrator Community Development Building Inspection County Counsel County Assessor County Treasurer -Tax Collector County Auditor- Controller Engineering Services Ms. Rennacker
