SPECIFIC REOUEST(S)OR RECOMMENDATION(S)A BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
A. Approve and appoint the Sheriff as the County's Fish and
Game Warden under Section 875 of the California Fish &
Game Code.
B. Agree that the Sheriff, as County Fish and Game Warden,
would provide quarterly reports to the Board through the
County Fish and Game Commission under Section 879 of the
California Fish & Game Code.
C. Approve and appoint Deputy Sheriffs assigned to the
Sheriff's Marine Services Bureau to act as Deputy County
Fish and Game Wardens under Section 880 of the California
Fish & Game Code.
D. Agree to continue Board policy originally passed April
30, 1985, authorizing use of funds in Budget Unit 0367 -
Game Protection Fund - for the Sheriff's Department
Marine Services Bureau subject to normal County budget
and appropriation procedures.

II . FINANCIAL IMPACT:
This fund received revenue from fines levied from California
Fish & Game violations. The Sheriff' s Department Marine
Services Bureau Deputies have been enforcing Fish & Game
laws for the past seven years which has increased the fund by
several thousand dollars.
Because of budget reductions, the Sheriff ' s Marine Patrol
personnel have been cut during each of the past two years.
The reduction has also brought about a lowering of proactive
law enforcement of Fish & Game violations. The reduction
will also reduce funds collected for the year. But it is
anticipated that more funding will be available for the
Marine Patrol unit in the future.
III . REASONS FOR RECOMMENDATION/BACKGROUND:
In April 1985, the Board of Supervisors passed a resolution
making the Sheriff' s Department Marine Patrol Deputies
County Fish and Game Wardens. The primary goal of this
proposal was to reduce illegal fish and game activities in
the County' s waterways by educating the public, working with
the courts and the District Attorney, and by actively
pursuing violations.
The funds, which have been generated by the fines, have lead
to the purchase of various equipment to assist Marine
Services Bureau personnel to apprehend numerous fish and
game violations and some water polluters. Funds also go to
the Lindsay Museum for wildlife education and survival. The
Marine Services Bureau has conducted public education talks
which have addressed boating safety and fish and game laws.
Section 875 of the California Fish & Game Code states that
the Board of Supervisors must appoint the County Fish and
Game Warden every two years. The last appointment was made
in December 1990. It is now time to address the matter.
IV. CONSEQUENCES OF NEGATIVE ACTION:
There will be a reduction in funds due to the lack of having
such a unit. The greatest loss will be felt by the wildlife
for they are the ones that cannot protect themselves from
poachers, fisherman who take over the legal amount, and the
polluters.
