CO DATE: December 10, 1992 r°TTA UH'�C4 SUBJECT: AMENDMENT ,TO THE 1993 LEGISLATIVE PROGRAM SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Strike item #5 of the Legislative Program adopted by the Board of Supervisors on December 8, 1992 and replace it with the following language: 5A. Expand Program Realignment to include juvenile justice programs - Support realignment of juvenile justice funding and program responsibility for CYA funds . Program Realignment enacted in 1991 has worked well in keeping the realigned programs out of the annual fight over dollars which has characterized the State Budget over the past several years . Program Realignment has had problems because the funding for these programs is now substantially tied to the State' s economy, which has not been performing as well as anyone anticipated when Program Realignment was enacted. Hopefully, this is a relatively temporary problem which will disappear when the economy improves. It has been suggested that in additional to specified health, social service and mental health programs, other programs should be included' in Program Realignment. One which should ' be looked at for inclusion in Program Realignment is the California Youth Authority (CYA) programs . The model for this type of Program Realignment was the transfer of responsibility for State Hospital cases to the counties . . This provides the county with the flexibility to identify, contract for or construct local facilities which appropriately meet the needs of some patients so that the population in the State Hospital can be reduced or at least additional patients need not be added in the same numbers seen in the past. The parallel here would be the county' s commitments to the CYA. A replacement source of revenue would be identified for the counties . Each county could then use that money to purchase beds in CYA facilities if it wished to do so or if a particular minor required that type of care. Other alternative types of facilities could be identified, contracted for or constructed at the local level to care for the other minors not committed to the CYA. 5B. Develop a fuller partnership with the State Department of Alcohol and Drug Programs - Support efforts to obtain greater flexibility in the use of State and Federal alcohol and drug funds . One of the program areas which has been mentioned as a possible candidate for inclusion in Program Realignment are alcohol and drug programs. These programs are funded in part by State and Federal funds and are administered by the counties . However, rather than immediately opting for the inclusion of alcohol and drug programs in Program Realignment, it is believed to be more appropriate to work with the State Department of Alcohol and Drug Programs in an effort to forge a closer working relationship between the counties and the Department, and to insure that the Department is aware of the fiscal and programmatic problems being faced by the counties . In addition, counties need to seek greater fiscal and programmatic flexibility in the use of alcohol and drug funds, some of which was accomplished in 1992 with the enactment of AB 2591 (Chapter 584, Statutes of 1992) which provides additional flexibility in the use of State alcohol and drug funds . These efforts need to be continued and enhanced. As long as cooperative efforts are making progress which is judged to be significant, inclusion of alcohol and drug programs in Program Realignment should not be necessary. Only if it is determined that such a dialogue is impossible or is not achieving sufficient progress should alcohol and drug programs be considered a viable candidate for Program Realignment. In this regard, Supervisor McPeak, the County Administrator, the Health Services Director and the County's lobbyist should be authorized to continue these discussions . BACKGROUND: On December 8, 1992, the Board of Supervisors adopted its 1993 Legislative Program. As a part of this Program, it was suggested by staff that Program Realignment be expanded to include juvenile justice programs as well as alcohol and drug programs. Following the adoption of the 1993 Legislative Program, Supervisor McPeak noted that she was engaged in a series of discussions with the Department of Alcohol and Drug Programs . If these meetings go well, she would prefer not to include alcohol and drug programs within Program Realignment. If these discussions break down or are not making sufficient progress, then it would be appropriate to consider including these programs within Program Realignment. Therefore, the above language should be adopted to replace in full the language which was included in Item #5 of the 1993 Legislative Program as it was originally adopted on December 8, 1992 . -2-
