MICHAEL WALFORD, CHIEF ENGINEER DATE: DECEMBER 15, 1992 SUBJECT: DA56 - LINDSEY BASIN EXPANSION SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE Right of Way Contract and Lease Agreement and ACCEPT Grant Deed dated December 3, 1992 from Ronald E. Nunn. B. AUTHORIZE Chief Engineer to execute said Right of Way Contract and Lease Agreement on behalf of the District. C. APPROVE payment of $1,376,220.00 for said property rights and AUTHORIZE the Auditor-Controller to issue a check in said amount payable to Founders Title Company, 659 Main Street; Martinez, CA., 94553, Escrow No. 153512-MA, to be forwarded to the Real Property Division for delivery. D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded in the office of the County Recorder. II. Financiallmpact: This acquisition is being financed through a combination of cash on hand (developers' fees) in Drainage Area 56, a Revolving Fund Loan (to be repaid from future developers'fees) and Flood Control District funds. Reasons for Recommendations and Background: These property rights are required for the expansion and reconfiguration of the Lindsey Basin made necessary by several planned road projects in the southeast Antioch area. IV. Consequences of Negative Action: The Drainage Area will not have sufficient land rights to allow enlargement and redesign of the basin in accordance with future development planned for southeast Antioch.
