MICHAEL WALFORD, CHIEF ENGINEER DATE: DECEMBER 15, 1992 SUBJECT: SALE OF POSSIBLE SURPLUS FLOOD CONTROL DISTRICT PROPERTY SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: DECLARE INTENT to sell surplus property resulting from the Lindsey Basin Expansion project to Contra Costa County;for the same price paid by the District. At such time as surplus property is identified, County will have 90 days notice from District to purchase or reject the property. II. Financial Impact: The purchase of the real property by the County is completely funded by bond proceeds restricted to capital expenditures only. The bond proceeds are not supported by County general funds. The District may be reimbursed for amounts spent to acquire property that may no longer be necessary for flood control purposes. Ill. Reasons for Recommendations and Background: The Flood Control District is purchasing right of way for the expansion of the Lindsey Basin. The District is purchasing sufficient right of way to provide necessary flexibility in the siting and configuration of the basin. When the District's plans are complete, there may be some surplus acreage. If the surplus is of sufficient size and configuration (4 to 6 acres), the County intends purchase this acreage.gat the same price the District is purchasing it for, to meet future County needs. At the time any surplus property is identified, the County will declare its intention to purchase said property and proceed with all required notifications. Consequences of Negative Action: The County may lose the opportunity to purchase needed property at a more affordable price than will be required in a few years time. The subject property is ideally situated for County purposes. There may be no suitable land left to acquire in years to come which offers the same affordabilty and location advantages. The District may have to find another buyer through the public auction process'. i.
