RECOMMENDATIONS
Approve Acme Fill Corporation's request for extending the validity
period of Land Use Permit 2122-86 from October 31, 1993 to October
31, 1994 .
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
Condition 3 . 1 of Land Use Permit 2122-86 (LUP) requires Acme to
install the pre-requisite improvements and open the permanent
transfer station for receiving waste within three years of final
approval of the Solid Waste Facilities Permit (SWFP) . This permit,
approved by the California Integrated Waste Management Board on
October 31, 1990, governs the operation of the transfer station.
In its letter of December 3 , 1992, Acme requests that the Board
extend the LUP. validity period, which is conditioned on the
issuance of the SWFP, for one year until October 31, 1994 . The LUP
Conditions of Approval provide for a one-year extension. It is
customary to grant such requests for reason. As stated in Acme's
letter, the solid waste franchising jurisdictions in central county
have been reluctant to commit their wastestreams to the permanent
transfer station. Without such commitments, it has been difficult
to prepare a financing program for the project.
Acme is continuing to move forward on the permitting and
implementation of. the station. Approval of Phase 3 construction,
consisting of the utilities and building foundations, is imminent
and work could begin in January 1993 . The preliminary design
drawings for Phase 4, the erection of site buildings, have been
completed by Acme's consultant and final drawings will be submitted
to our Department by January 1, 1993 .

Acme has made its best efforts to comply with this deadline and all other aspects of the
Land Use Permit. The required sound walls, improvements to Waterbird Way, submittal
of preliminary plans, and the composting pilot project have all been put into place. The
design of the project has continued, construction plans have been prepared (and approved
by the County), and bids have been requested and received for major foundation and
utility work at the site. However, the uncertainties described above have impacted the
scheduling of this work. . Acme has also maintained its financing status with the
California Pollution Control Finance Authority, by obtaining an extension on financing
through December 1993.
