MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: DECEMBER 15, 1992 SUBJECT: PURCHASE OF POSSIBLE SURPLUS FLOOD CONTROL DISTRICT PROPERTY SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: A. DECLARE INTENT to purchase property from the Contra Costa County Flood Control and Water Conservation District, for the same price paid by the District, should the District have at least 4 to 6 acres of surplus in an acceptable configuration. The County will purchase or reject the property within 90 days notice from the District to do so. B. FIND that the project will not have a significant effect on the environment, and DETERMINE that the project is exempt from the requirements of the California Environmental Quality Act as a Class 15 Categorical Exemption under County Guidelines and Section 15315 of the State CEQA Guidelines, and QIRECT the Director of Community Development to file a Notice of Exemption with the County Clerk and DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk for filing of the Notice of Exemption. This activity has been found to conform to the General Plan of Contra Costa County. II. Financial Impact: The purchase of the real property by the County is completely funded by bond proceeds restricted to capital expenditures only. The bond proceeds are not supported.by County general funds. Accounting Purchase of Surplus Flood Control District Property December 15, 1992 Page Two III. Reasons for Recommendations and Background: District is purchasing approximately 22.7 acres of land for the future expansion and reconfigura- tion of the Lindsey Basin. The exact size and configuration of the basin is not known at this time but will be determined within the next year. When the design and siting of the basin is completed, there may be surplus property which the District would no longer require. County is desirous of acquiring land in east county for a future East County Government Center and this property would afford an acceptable location. In the event that surplus property is available after completion of District's plans, County intends to purchase, and District intends to sell to County, for the same price paid by District, 4 to 6 acres of said surplus provided that it is of adequate size and configuration for County's purposes. At the time the surplus property is identified, the District will notify the County that it has 90 days in which to declare its intention to purchase said property and proceed with all required notifications. IV. Consequences of Negative Action: The County may lose the opportunity to purchase needed property at a more affordable price than will be required in a few years time. The subject property is ideally situated for County purposes. There may be no suitable land left to acquire in years to come which offers the same affordabilty and location advantages.
