ADOPTION OF A RESOLUTION TO IMPLEMENT PORTIONS OF AB 303
SUBJECT: (CHAPTER 153, STATUTES OF 1991) IN CONTRA COSTA COUNTY
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt the attached Resolution which will permit employees who
retire under Tier II to return to work when they possess special
skills or knowledge for up to 12.0 working days or, 960 hours per
year, whichever is greater, without placing their retired status
in jeopardy.
BACKGROUND:
As a part of its 1991 Legislative Program, the Board of
Supervisors sponsored legislation to increase the number of hours
or days per year which a retired employee could work without
jeopardizing his or her retirement status and pay. The law
already provided that where an employee possesses special skills
or knowledge, the County can reemploy the individual for up to 90
days or 720 hours per year. The County does make use of this.
provision where an employee has retired and possesses special
skills or knowledge which cannot easily and quickly be replaced.
Assemblyman Baker carried. AB 303 for the County. AB 303 allowed
any 1937 Act county to reemploy such an individual. for 12.0 days
or 960 hours, whichever is greater, rather than 90 days or 720
hours. In order to insure that Contra Costa County' s Tier II
retirees were covered by this provision, , AB 303 also contained a
provision permitting the Board of Supervisors to extend this same
provision to Tier II retirees. at the same 120 days or 960 hours

level. This latter provision required that the Board of
Supervisors adopt a Resolution by majority vote in order to make
this provision applicable to Tier II retirees..
AB 303, which contained an urgency clause, passed the Legislature
and was signed into law by the Governor on July 22, 1991. It
became effective July 23 , 1991 upon being filed with the
Secretary of State. It is, therefore, appropriate for the Board
of Supervisors to now adopt the necessary Resolution to fully
implement AB 303 in Contra. Costa County.
