HomeMy WebLinkAboutMINUTES - 11191991 - 1.59 l � y THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA IN THE MATTER, OF ADOPTION OF A ) RESOLUTION TO IMPLEMENT PORTIONS ) OF AB 303 IN CONTRA COSTA COUNTY ) RESOLUTION 91/763 WHEREAS, the Legislature has passed and the Governor has signed into law AB 303 (Chapter 153 , Statutes of 1991) which permits Tier II retirees to be reemployed by the County, where the retiree possesses special. skills or knowledge, not to exceed 120 working days or 960 hours per year, whichever is greater, and WHEREAS, Section 31680.6 of the Government Code, which was added by Chapter 153 , Statutes. of 1991, effective July 23 , 1991, requires the adoption of a Resolution by a majority vote of the Board of Supervisors of Contra Costa County in order to provide this additional reemployment opportunity to Tier II retirees, and WHEREAS, the Board of Supervisors of Contra Costa County wishes to exercise its option of being able to reemploy retired employees who are subject to Government Code Section 31680. 2 for up to 120 working days or 960 hours, whichever is greater, per year in cases where the retired employee possesses special skills or knowledge; NOW, THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA RESOLVED: THAT the adoption of this Resolution by a majority vote of the Board of Supervisors is intended to satisfy the requirements of Government Code Section 31680.6 as added by Chapter 153, Statutes of 1991 and, notwithstanding the provisions of Government Code Section 31680. 2, the Board of Supervisors hereby extends the period of time provided for in Government Code Section 31680. 2 for which a person who has retired may be employed in a position requiring special skills or knowledge, as determined by the county or district employing the individual, to not to exceed 120 working days or 960 hours, whichever is greater, in any one fiscal year. Passed on November 19, 1991, by unanimous vote of the Board members present. BACKGROUND: As a part of its 1991 Legislative Program, the Board of Supervisors sponsored legislation to increase the number of hours or days per year which a retired employee could work without jeopardizing his or her retirement status and pay. The law already provided that where an employee possesses special skills or knowledge, the County can reemploy the individual for up to 90 days or 720 hours per year. The County does make use of this. provision where an employee has retired and possesses special skills or knowledge which cannot easily and quickly be replaced. Assemblyman Baker carried. AB 303 for the County. AB 303 allowed any 1937 Act county to reemploy such an individual. for 12.0 days or 960 hours, whichever is greater, rather than 90 days or 720 hours. This latter provision required that the Board of Supervisors adopt a Resolution by majority vote in order to make this provision applicable to Tier II retirees.. AB 303, which contained an urgency clause, passed the Legislature and was signed into law by the Governor on July 22, 1991. It became effective July 23 , 1991 upon being filed with the Secretary of State. It is, therefore, appropriate for the Board of Supervisors to now adopt the necessary Resolution to fully implement AB 303 in Contra. Costa County.
