SUBJECT: SET PUBLIC HEARING FOR ANNEXATION OF CONTRA COSTA COUNTY
SANITATION DISTRICT NO. 15, ZONE 4 TO OAKLEY SANITARY DISTRICT, AS WELL
AS, THE FORMATION OF COUNTY SERVICE AREAS M-26, M-27, AND M-28
SPECIFIC REQUEST(S)OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
1. Recommended Action:
1. FIX December 10, 1991, at 11:00 a.m. for a Public Hearing by the Board of
Supervisors to perform the required tasks as conducting authority for the annexation
of Contra Costa County Sanitation District No. 15, Zone 4 to Oakley Sanitary District,
for the dissolution of Sanitation District No. 15, Zones 1, 2, and 3 and the formation
of County Service Areas M-26, M-27, and M-28 for the operation and maintenance of
three domestic water systems currently in Contra Costa County Sanitation District No.
15.
2. DIRECT the Clerk of the Board to complete the necessary documents including
posting, publishing and mailing the said notice of Public Hearing according to
Government Code Section 57002.

III. Reasons for Recommendations and Background:
On November 13, 1991, Local Agency Formation Commission considered and approved the
said application requesting the Local Agency Formation Commission to take proceedings
for the combining of Oakley Sanitary District, Oakley-Bethel Island Wastewater Management
Authority and Contra Costa County Sanitation District No. 15.
The next step in the process is for the Board to initiate proceedings for the proposed
annexation in compliance with the Local Agency Formation Commission Resolution, which
authorizes the conducting authority to conduct such proceeding with notice and hearing.
Government Code Section 57002 requires that within 35 days following adoption of the Local
Agency Formation Commission Resolution making determinations, the clerk of the
conducting body shall set the annexation proposal for hearing and give notice by posting,
publishing and mailing. The date of the hearing shall not be less than 15 days or more than
60 days after the date the notice is given. This scheduled hearing is a legal requirement.
