MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: November 19, 1991 SUBJECT: Report from Assessment District Screening Committee Recommending Disapproval of the Proposed Assessment District for the Bethel Island Levees. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: 1. ACCEPT the report from the Assessment District Screening Committee recommending the Board not form an Assessment District for reconstructing the Bethel Island levees. 2. DISAPPROVE the request for formation of an assessment district to finance a portion of the Bethel Island levee reconstruction costs. II. Financial Impact: None III. Reasons for Recommendations and Background: On Thursday June 13, 1991 the Assessment District Screening Committee met to consider a request by several Bethel Island property owners for the formation of an assessment district to finance $4.5 million of the total $20 million required for the reconstruction and stabilization of the island levee. The Bethel Island Municipal Improvement District (BIMID) anticipates receiving the remaining $15.5 million from State funds. However, additional input from the Community Development 1Department pointed out the premature nature of the request as it assumes development on Bethel Island which has not been approved and requested the Committee further discuss the matter. On Tuesday August 20, 1991, the Assessment District Screening Committee met again to reconsider the request. After extensive discussion, the Committee adopted the following: 1. An assessment district may be an appropriate mechanism to provide funding toward shared costs to reconstruct the Bethel Island levee to required standards required for urban development. However, any recommendation to that effect is premature and would need to await the completion of the studies called for in the Bethel Island Specific Plan, the County General Plan with'a General Plan amendment, and development approvals. 2. This Committee believes it should'not further consider formation of an assessment district until the Bethel Island Specific Plan is arranged to allow a level of development which could support the bond indebtness. IV. Consequences of Negative Action: The County could be held financially responsible for the assessments if development does not occur.
