SUBJECT: AUTHORIZE USE OF MITIGATION FUNDS
SPECIFIC REQUEST(S)OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
1. AUTHORIZE the temporary use of $25,000 from the San Ramon Creek Watershed
Mitigation Funds and $25,000 from the Miranda Creek Watershed Mitigation Funds for
upgrading the Miranda Creek culvert at Ersilia Trail.
2. APPROVE and AUTHORIZE the Chair of the Board to execute an agreement between
Contra Costa County and Thomas Barry Construction for the construction of a creek
bypass pipe system on Miranda Creek as part of Subdivision 7099 off-site improvements.
II. Financiallmpact:
The Mitigation Fund balances will be reduced by $50,000.
111. Reasons for Recommendations and Background:
Developments in the Miranda Creek Watershed, a subsidiary watershed to San Ramon Creek,
have been mitigating their hydrology impact on Miranda Creek by flow reduction basins, creek
improvements or financial participation in regional improvements. The Miranda Creek Mitigation
Account has $25,900 in contributions. A developer in the area is required to extend the existing
culvert under Ersilia Trail as a condition of approval for this, development. He has agreed to
install a second culvert to increase the capacity of the crossing to accommodate the design flow
provided the County funds the additional cost. This work is beyond his mitigation responsibility.
The $25,000 from the San Ramon Creek Watershed account will be returned by future
developments in the Miranda Creek Watershed.

The existing culvert is a "bottleneck" in the Miranda Creek System. It is recommended that the
culvert system be enlarged at this time.
IV. Consequences of Negative Action:
The culvert system will remain a "bottleneck" in the Miranda Creek System.
