SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
APPROVE Right of Way Contract and ACCEPT Grant Deed dated November 12,
1991 from Julius Deubner and authorize the Redevelopment Director or
his Designee to execute said agreement on behalf of the Agency.
FISCAL IMPACT
The Contract provides for the Agency to acquire the above referenced
property for the sales price of $466, 662 . The Agency has sufficient
funds in its low and moderate income housing set-aside accounts to
cover the acquisition costs.
BACKGROUND/REASONS FOR RECOMMENDATIONS,
The subject property is part of development Area 4 in the Pleasant
Hill BART Station Area. This development area was originally to be
developed by a partnership of Glenfed Development Corp. and Desco
Investment. That partnership was unable to perform and will not be
pursuing development on this site.
The subject property is immediately adjacent to the child care center
being developed as part of the Park Regency Project. The approved
development plan for the residential project on Area 4 required the
provision of an easement on what is currently the Deubner prop rty.

This easement would be provided so that the child care center could
secure additional outdoor space and therefore meet state licensing
requirements for a child care center with a capacity of 92 .
Without the easement, the child care center capacity would be
approximately 60, which is not an economic viable size.
The developer of the child care project is prepared to move forward
with their design plans. They need to be guaranteed that the
easement is going to be available to them. With the Agency
purchasing this property, the Agency can provide said easement as
part of subsequent agreements with the child care operator.
