HomeMy WebLinkAboutMINUTES - 11191991 - 1.1 (4) 1 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on November 19, 1991 by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson and Powers NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 91/741 SUBJECT: Approval of the Final Map, Subdivision Agreement, and Road Improvement Agreements for the Widening of Highway 4 and the Construction of a Trail along the Contra Costa Canal, for Subdivision 7365, Oakley Area. The following documents were presented for Board approval this date: The Final Map of Subdivision 7365, property located in the Oakley area, said map having been certified by the proper officials. A Subdivision Agreement with Kaufman and Broad of Northern California, Incorporated, subdivider, whereby said subdivider agrees to complete all improvements as required in said Subdivision Agreement within one year from the date of said agreement. Said documents were accompanied by: I. Security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 198155, dated November 1, 1991) in the amount of$6,781 made by Kaufman and Broad of Northern California, Incorporated. B. Additional security in the form of a corporate surety bond dated October 28, 1991, and issued by American Casualty Company of Reading, Pennsylvania and The American Insurance Company(Bond No. 400815519-AMCAS and 11132943009-AIC respectively) with Kaufman and Broad of Northern California, Incorporated as principal, in the amount of$671,300 for faithful performance and $339,050 for labor and materials. II. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1991/92 tax lien has been paid in full. A Road Improvement Agreement with Kaufman and Broad of Northern California, Incorporated, developer, whereby said developer agrees to complete all improvements as required in said Road Improvement Agreement within one year from the date of said agreement. Improvements generally consist of a trail along the Contra Costa Canal. Said document was accompanied by the following: Security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: a. Cash deposit (Auditor's Deposit Permit No. 198838, dated November 19, 1991) in the amount of $1,000, made by Kaufman and Broad of Northern California, Incorporated. b. Additional security in the form of a corporate surety bond dated November 14, 1991, and issued by American Casualty Company of Reading,Pennsylvania(Bond No. 400815617)with Kaufman and Broad of Northern California, Incorporated as principal, in the amount of J $14,800 for faithful performance and $7,900 for labor and materials. A Road Improvement Agreement with Kaufman and Broad of Northern California, Incorporated, developer, whereby said developer agrees to complete all improvements as required in said Road Improvement Agreement within one year from the date of said agreement. Improvements generally consist of the widening of Highway 4. Cash deposit (Auditor's Deposit Permit No. 198838, dated November 19, 1991) in the amount of $1,100, made by Kaufman and Broad of Northern California, Incorporated. b. Additional security in the form of a corporate surety bond dated November 14, 1991, and issued by American Casualty Company of Reading, Pennsylvania and The American Insurance Company as co-sureties (Bond No. 400815603-AMCAS and 11132943025-AIC) with Kaufman and Broad of Northern California, Incorporated as principal, in the amount of $108,775 for faithful performance and $54,938 for labor and materials. ' NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans. BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use.
