IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Oakland-Berkeley ) Firestorm of October 20, 1991 ) RESOLUTION NO. 91/738 WHEREAS in its capacities as the Board of Supervisors of Contra Costa County and as the Governing Board of the Contra Costa County, Moraga, Orinda, Riverview, and West Fire Protection Districts, and of the Housing Authority of ContralCosta County, this Board has taken under consideration the extraordinary Oakland-Berkeley Firestorm of October 20, 1991, its impact upon Countylemployees, and has determined that the County can best assist its employees who aie personally impacted by the fire and its after effects by allowing those employees who are so affected paid time off to handle their resulting problems; and WHEREAS it has been determined that County employees whose personal living accommodations were damaged or destroyed, or whose personal property was damaged or destroyed, or who were injured during the fire may be given a reasonable time off work during the period of October 20, 1991 through April 30, 1992,, to attend to their changed personal situations without charge to any other leave accruals, at the discretion of their appointing authority and approval by the County Administrator on a case-by-case basis; and i WHEREAS it has been further determined that department heads may use reasonable judgement with regard to other employees who have lost, or may lose, time directly related to the fire during the period noted above, and that requests for time off because of personal concerns or personal circumstances may be honoredibut the time off will be on the employee's own time with the employee electing to utilize vacation, compensatory time, administrative leave accruals, holiday time or sick leave, depending upon the circumstances; and WHEREAS the appointing authority shall provide to the County Administrator a monthly listing of all such leave requested by their employees, the reasons therefor, and appointing authority's approval or denial of such requests and the reasons for such action with the County Administrator to provide the Board a summary report of all such leave granted by June 2, 1992; and WHEREAS. any paid leave time granted under this Order shall be considered time off work and shall be treated similarly to vacation in relation to workers' compensation; and WHEREAS this Resolution is an emergency action, the fire having occurred on October 20, 1991, and employees currently affected as described above; and WHEREAS the Employee Relations Officer shall give notice of this Resolution to all recognized employee organizations; and WHEREAS to the extent that the subjects of this Resolution are within the scope of representation under the Meyer-Milias-Brown Act (Government Code Sections 3500 et. seq.), this Board offers to meet with any recognized employee organization upon request concerning this Resolution. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Contra Costa, California, hereby ADOPTS this Resolution on the 5th day of November, 1991, by unanimous vote of the Board members present.
