SUBJECT: Electronic Home Detention Program: Revision of Fees
and County. Parole
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I RECOMMENDED ACTION:
Approve and authorize the Sheriff-Coroner to establish program fees
pursuant to Penal Code Section 1208.2 (new section applicable to County
Parole and Electronic Home Detention fees.) . Increase preexisting fees
paid by each applicant/participant in the County Parole and Electronic
Home Detention programs as follows:
Interview/Application fee of $50. 00 plus $7. 00 (minimum) for each day
served in the program, based upon his or her ability to pay.
II : FINANCIAL IMPACT:
Approval will result in additional revenue to the Electronic Home
Detention ( less than two years old) and County -Parole programs. During
fiscal year 90-91, these programs produced $195,0001 in combined
revenues. This represents 670 of the $289, 000 combined operational
costs. Increased fees will allow these programs to produce additional
revenues necessary for offsetting operational costs to the County. The
amount of additional revenues that will be generated. is unpredictable at
this time. In any event, it is anticipated that they should be several
thousand dollars.
III . REASONS FOR RECOMMENDATION:
Electronic Home Detention and. County Parole have experienced substantial.
growth in the number of inmate participants and court referrals. The
closure of the Work Furlough Facility has and will continue to impact
upon continued growth. Programs have necessarily increased staffing and
office space. The increase in staffing, coupled with the continual
growth of the programs, requires additional funds to offset the cost of
salaries, equipment, lease of additional office space and maintenance of
existing budgetary needs.

IV. BACKGROUND:

In 1989, the Board. of. Supervisors, by Board Order (Resolution. No.
83/361) established the Electronic Home Detention Programlpursuant to
the authority granted the Board of Supervisors in Penal Code Section
1203. 016.
The fees were set to match that of the other constructive custody
programs operated by the Sheriff-Coroner.
Since 1987 and prior to the enactment. of Penal Code Section 1208.2,
County Parole fees were collected pursuant to Order of the County' s
presiding court and, as established by statute.
A request for an increase in fees in other programs, coinci es. with this
Board Order to maintain a stable fee schedule.
The programs fees are currently $40.00 application fee and $5.00
(minimum) 'for each. day served in the program.

V. CONSEQUENCES OF NEGATIVE ACTION:
Budgetary needs for the operation of the Electronic Home Detention and
County Parole programs for fiscal year 1991-1992 will exceed those of
the previous year. Increased numbers on the program will provide for
some of the needed increase in revenues but, not all. If this proposal
is not approved., the ability to generate the. additional. revenues will be
lost. Fees charged will remain at the same rate and the percentage of
program cost paid for' by the county for these valuable programs will
increase.

I . RECOMMENDED ACTION:

Approve and authorize the Sheriff-Coroner to increase fees. paid by every
person accepted as a participant in the Work Alternative Program as
follows: j
Interview/Application fee of $50. 0,0 plus, $7. 00 for each day of work to
be scheduled, based on his or her ability to pay. !
II . FINANCIAL IMPACT:
Authorization will enable. the Work. Alternative Program to continue to
operate with the pro rata cost of administration paid by each
participant, based upon his or her ability to pay, with no program cost
incurred by the County.
III . REASONS FOR RECO14MENDATION:
Since the incepti.on of. the Work Alternative Program (WAP) , there has
been increased growth in the number of court referrals.The continuing
growth of the program has necessitated increasing the program' s staff
and office space. Increased staffing and program population levels have
necessarily prompted the need for additional funds to offselt the cost of
salaries, equipment, lease of additional office space and maintenance of
existing budgetary needs.
IV. BACKGROUND:
In 1983, the Board of Supervisors, by Board Order (Resolution No.

V. CONSEQUENCES OF NEGATIVE ACTION:
Budgetary needs for the operation of the Work Alternative ; Program for
fiscal year 1991-1992 require $753,000 in expenditures with estimated
revenue of $583,000. Projections indicate that the Work Alternative
Program can reasonably expect to complete 7,200 interviews and schedule
38 ,000 days of work. The fee increases of $50. 00 for application and
$7. 00 for each day of work scheduled will have the following results:

SUBJECT: In the Matter of Authorizing Sheriff-Coroner to Modify Fee Schedule
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION
Adopt the attached fee schedule effective July 1, 1991.

II. FINANCIAL IMPACT
The requested modifications are minor adjustments that are expected to increase
revenue by approximately $15,000 annually.
III. REASONS FOR RECOMMENDATION
This fee schedule was last modified by the Board on August 6, 1987. Since that time the
cost of providing the service covered has increased.
IV. BACKGROUND
The Sheriff-Coroner's Department creates/maintains on file a great many incident
reports, accident reports and other documents. Access to and copies of these records
is requested by involved parties, insurance companies and crime victims. The Public
Records Act generally requires that such records be made available and permits
charging the direct cost of duplication or a statutory fee.
The fee schedule recommended will more closely align revenue with actual costs and
reflect cost of living increases since 1987.
V. CONSEQUENCES OF NEGATIVE ACTION
Negative action will cause revenue to remain at its current level which is less than the
cost of providing the required services.
