RECOMMENDED ACTION: ADOPT Resolution No. 3618 authorizing the execution of Amendment No. 44 to Annual Contributions Contract No. SF-182 and approving execution and recordation of Declaration of Trust and AUTHORIZE the Chairman of the Board of Commissioners and the Executive Director of the Housing Authority of the County of Contra Costa to execute all necessary HUD contract documents for the $4,153,000 in Comprehensive Improvement Assistance Program funds approved for FY 1991, as recommended by the Advisory Housing Commission. II. FINANCIAL IMPACT: Funding has been approved by the U. S. Department of Housing and Urban Development (HUD) under its Comprehensive Improvement Assistance Program (CIAP) in the total of amount of $4,153,000 for the modernization of project CA011003, Bridgemont, Antioch, for comprehensive completed and special purpose modernization work at project CA011005, El Pueblo in Pittsburg; and for comprehensive completed and special modernization work at projects CA011006, CA011009A and CA011009B, Las Deltas in North Richmond. III. REASONS FOR" RECOMMENDATION/BACKGROUND: On September 27, 1991 the Housing Authority of the County of Contra Costa received a letter from Robert J. De Monte, Regional Administrator-Regional Housing Commissioner, San Francisco Regional Office of the Department of Housing and Urban Development, announcing that our final Comprehensive Improvement Assistance Program (CIAP) application for Fiscal Year 1991 CIAP funding had been approved in the total amount of $4,153,000. The CIAP final application was approved for submission to HUD by the Board of Commissioners on April 2, 1991. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not adopt Resolution No. 3618, authorizng the execution of Amendment No. 44 to the Annual ContributionsfContract No. SF-182, and approving the execution and recordation of the Declaration of Trust, the Department of Housing and Urban Development would withdraw its allocation of $4,153,000, thereby jeopardizing the modernization of CA011003, Bridgemont, Antioch, and the necessary comprehensive completed and special purpose work at four housing developments. Additionally, the Board of Commissioners would be adopting a posture contrary to its position of providing decent, safe and sanitary housing for low-income families. is ti I THE BOARD OF COMMISSIONERS, HOUSING AUTHORITY OF THE COUNTY OF CONTRA COSTA i RESOLUTION NO. 3618 RESOLUTION APPROVING MODERNIZATION PROJECT GRANT TO CONSOLIDATED ANNUAL CONTRIBUTIONS CONTRACT NO. SF-182 AUTHORIZING ITS EXECUTION AND APPROVING EXECUTION AND RECORDATION OF DECLARATION OF TRUST WHEREAS, the Housing Authority of the County of Contra Costa (herein called the "Local Authority") entered into a Consolidated Annual i Contributions Contract on February 24, 1962 (as amended) , with the United States of America (herein called the "Government") ; and, WHEREAS, �it is deemed'ladvisable by the Local Authority and the Government oto amend thejConsolidated Annual Contributions Contract in the ,particulars indicated in such Amendment: NOW, THERIEFORE, BE IT RESOLVED by the Board of Commissioners of the Housing Authority of the County of Contra Costa, as follows: 1. The amendment to the Annual Contributions Contract is hereby approved and accepted. The Chair or Vice Chair is hereby authorized and directed to execute seven counterparts of the Amendment onlbehalf of the Local Authority, and the Secretary is hereby authorized to impress and attest the official seal of the Local Authority on each such counterpart and to forward such , executed counterparts, or any of them, to the Government together with such other documents evidencing the approval and authorizing the execution thereof as may be required by the Government. 2. Pursuant' to the provisions of the Consolidated Annual Contributions Contract, the Declaration of Trust pertaining to the project or projects assisted by the modernization grant is hereby approved and accepted and the Chair or Vice Chair is hereby authorized and directed to execute each counterpart of the Declaration of Trust, the Secretary is hereby authorized to attest and impress the official seal of the Local Authority on each counterpart,' and thereafter the Declaration of Trust shall be recorded in the manner required by the laws of the State of California. 3. This Resolution shall take effect immediately.
