County_ CORRECTIONAL DETENTION CENTERS (SB 2000) FUNDING Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATIONS: Direct County Administrator, in cooperation with the Sheriff's Department and other appropriate agencies, to prepare a Substance Abuse Community Correctional Detention Center (SB 2000) funding proposal, and report back to the Board by January 31, 1992, with project proposal and analysis of potential benefits and/or disadvantages for the County from the proposal. FINANCIAL IMPACT: There is no financial impact at this time. There is no need for additional County general funds to prepare the proposal. If the proposal achieves a tentative funding award from the State, ensuing negotiations with the State would be required. If conditions favorable to the County in costs and operations cannot be achieved, the County will not be committed to contracting with the State. REASONS FOR RECOKMENDATION/BACKGROUND: The State Board of Corrections announced in a Request for Proposals that .$15 million in construction funding is available statewide under Chapter 1594, Statutes of 1990, establishing the Substance Abuse Community Correctional Detention Centers. The goal of the legislation is to develop model State/local substance abuse programs. The State will provide construction funding and operational costs reimbursement for State prisoners housed at the local facility. On September 24, 1991, the Board authorized submission of a non-binding "letter of intent" to the State and directed the County Administrator to report back by October 31, 1991, regarding whether to proceed further in the application process. Applications for funding are due to the State Board of Corrections by February 27, 1992. The Board will select projects for capital. funding by May 1992. Counties selected for capital funding have until December 1993 to begin construction; by that time, the County would also be required to have a "binding agreement" regarding reimbursement for operational costs. Based on inquiries to State officials and on discussions with the Sheriff's Department, it appears possible that contracts with favorable conditions regarding jail costs and operations can be negotiated. To apply for State funding, we will also need to specify the facility to be constructed or used. We will also need to identify a plan for "aftercare" services for prisoners as they are released from the in-custody program; this is a concern already under discussion in the Sheriff's Department. As indicated above, if ultimately a favorable contract cannot be negotiated. regarding the payment of both capital and operational costs, the County has no obligation to proceed.
