Project No.: 0662-6114134 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Director of Public Works to: (1) Transfer $446,180.00 from Tassajara Joint Exercise of Powers (JEPA) (Trust Account 8210) into West Pittsburg Area of Benefit (Trust Account 8195); (2) Transfer $336,341.00 from the Road Fund (1108-0662) to the West Pittsburg Area of Benefit (Trust Account 8195). II. Financial Impact: There will be no impact to the General Fund. The monies being transferred from the Tassajara JEPA and Road Fund were replaced with Federal Combined Road Plan (CRP) funds. 111. Reasons for Recommendations and Background: The Willow Pass Road widening project was originally approved to receive $1,011,000 CRP. funds. Under the CRP guidelines, the construction contract had to be awarded by June 1991. The Willow Pass Road project had two situations which might cause delays and jeopardize the funding. First, an underground utility district was approved for the area on June 6, 1989. This district will benefit the community and enhance the visual aesthetics of the area, but could have possibly delayed the advertisement of the project. Secondly, the widening project was in the process of review under the National Environmental Protection Act (NEPA). This review was causing potential delays due to the State Historic Preservation Office (SHPO) review. The SHPO review was estimated to take at least two years. November 5, 1991 Page 2 III. Reasons for Recommendations and Background: (Cont.) To safeguard the federal funds and assure construction of the widening of Willow Pass it was recommended to transfer the federal monies to projects that could meet the federal time constraints. The Willow Pass Road project would then be constructed with local monies without time constraints. Since local revenue was used, the NEPA process was abandoned and the project was reviewed and approved under the California Environmental Quality Act (CEQA). The Willow Pass Road CRP monies were used to construct projects on Camino Tassajara and Kirker Pass Road. Both these projects qualified for CRP funds and could meet the time requirements required of the federal process. The monies that would have been used to construct these projects will be transferred to the West Pittsburg Area of Benefit. IV. Consequences of Negative Action: The West Pittsburg Area of Benefit would have a shortfall of $782,521.00.
