HomeMy WebLinkAboutMINUTES - 10221991 - H.1 H. 1 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 22, 1991 by the following vote: AYES: Supervisors Schroder, McPeak and Powers NOES: Supervisor Torlakson ABSENT: Supervisor Fanden ABSTAIN: None --------------------------------------------------------------------- --------------------------------------------------------------------- SUBJECT: Hearing On Administrative Appeal By Carole Baird, Et Al, On Building Permit No. 170731, Clayton Area. On September 24 , 1991, the Board of Supervisors fixed this date and time for hearing of the administrative appeal by Carole Baird, et al, of the issuance of a Building Permit No. 170731 for construction of a youth drug facility at 11540 Marsh Creek Road, Clayton. Supervisor Fanden advised that she could not stay to hear all the testimony but would listen to the tape of the hearing. Supervisor Torlakson expressed his concerns relative to the approach and handling of this matter. Supervisor Powers advised that he had cards from people in opposition and that he would circulate them among Board members. The following persons appeared to speak: David Goldman, P.O. Box 2047, Oakland, attorney for the appellants, spoke in opposition to the building permit and commented on a list of exhibits he presented to the Board and he requested that the Board decide the building permit now rather than delay this matter for ninety days as requested* by Bi-Bett Corporation and advised by County Counsel. Ken Schiedig, 2530 Arnold Drive, Suite 360, Martinez , representing Bi-Bett Corporation spoke in opposition to the appeal and he spoke in support of his client and the staff ' s recommendation for a continuance. Mr. Goldman spoke in rebuttal. Victor Westman, County Counsel, noted the Board' s receipt of his office' s October 21, 1991 memorandum and recommended leaving the public hearing open to enable Bi-Bett and staff to make a further presentation, and he commented on the matter being resolved in the meantime. Supervisor Torlakson requested clarification on the role of the mediator. Mr. Westman responded to Supervisor Torlakson' s request. Supervisor Torlakson moved to grant the appeal and render the building permit invalid. The motion died for lack of a second. Supervisor Schroder moved the staff recommendation for a ninety day continuance. IT IS BY THE BOARD ORDERED that the hearing on the above matter is CONTINUED to January 21 , 1992 at 2 : 00 p.m. in the Board Chambers.
