O. 4200 SPECIFIC REQUEST(S) OR RECOMMENDATIONS) &BACKGROUND AND JUSTIFICATION I. Recommended Action: ACCEPT Quitclaim Deed dated August 20, 1991, from United Centro Properties. II. Financial Impact: None. III. Reasons for Recommendations and Background: The conveyance of this Quitclaim Deed for a fifty-foot-wide non-exclusive right of way is a condition of the settlement agreement in UNITED CENTRO PROPERTIES v. CONTRA COSTA COUNTY, litigation which arose as a result of the construction of the Vintage Parkway project in Oakley. In its suit, United Centro alleged damages to its property caused by the Hofmann Company's construction of the elevated roadway known as the"Vintage Parkway." In exchange for the Hofmann Company's payment of $40,000 consideration, United Centro agrees to waive all further claims and convey to the County its interest in the right of way. IV. Consequences of Negative Action: County would be in default of agreement with plaintiff.
