HomeMy WebLinkAboutMINUTES - 10151991 - S.4 BOARD OF SUPERVISORS � FROM: Supervisor Tom Torlakson Contra Costa Introduced October 8, 1991 Coin DATE: for Board Action October 15, 1991 SUBJECT: LEGAL AND RATE ISSUES IN THE FINAL STEPS FOR ESTABLISHING LANDFILLS r SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: Refer to the County Administrator's Office and County Counsel the following questions which I raised at the Board of Supervisors meeting of September 24 during our discussion of waste shed criteria and rate setting guidelines : ( 1 ) What analysis has been conducted of the total expected rate impact under the new landfills and the proposed transfer stations? (2) Is there really enough garbage in the county to 'support the enormous capital investment in two landfills? ( 3 ) What are the current projected capital costs for setting up the landfills and the operating costs to meet the state-of-the art, strict, modern operational conditions the Board of Supervisors has imposed? (4 ) What legal steps does the county still have within the franchise agreement and any other permitting authority to regulate this situation? Establishment of waste shed areas is obviously one tool . But, do we have the authority to allow one landfill to be "land banked" while operating only one for full operation at this time if it is determined that the rate impacts of setting up two sites are so great as to warrant this? (5 ) The major state-wide efforts being implemented under AB 939 in recycling and waste reduction will significantly alter the projected waste stream volume, therefore reducing the amount of - garbage to support landfill operations . What are the actual 'tonnage reductions we can estimate at this time to be effected through the combined curbside recycling efforts, thorough recycling at the transfer stations/material recovery centers combined with .extensive public education and potential consumer purchasing modifications? BACKGROUND INFORMATION: Two landfills are proceeding through the final stages of the permitting process at the regional and state level and litigation surrounding these sites is in the process of being resolved. Three transfer stations/material recovery centers are being actively pursued at this time. Construction may soon be ready to begin on one or more of these projects . Before such construction begins, before any permits are granted to allow such construction by any county department or this board, the above questions must be answered.
