THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on October 15 , 1991, by the following vote:
AYES: Supervisors Fanden, Schroder, McPeak, and Powers
NOES: Supervisor Torlakson
ABSENT: None

SUBJECT: Decision on Williamson Act Cancellation for Keller Canyon
Landfill.
On October 8, 1991 , the Board of Supervisors continued
to this date the consideration of the report from the Director of
Community Development recommending adoption of a resolution ap-
proving the final Certificate of Cancellation for Keller Canyon
Landfill' s Williamson Act Land Conservation Contract.
The following persons appeared to speak:
Tom Butterfield, 1221 Cape Cod Court, Concord, spoke in
favor of proceeding with the process.
Paul Fahje, 2101 Washington Way, Antioch, Local 3 , spoke
in favor of the project.
Mark August, 3288 D Street, Hayward, Operating Engi-
neer' s Local #3 , spoke in favor of the project.
Winton Jones, 1949 Arnold Industrial Way, Concord, spoke
in favor of Keller Canyon and local contractor participation.
William W. Lee, 2404 Dover Way, Pittsburg, spoke in
favor of Keller Canyon.
Kenneth C. Schiedig, 2530 Arnold Drive, Suite 360,
Martinez, representing the cities of Concord and Pittsburg, spoke
in opposition to the approval of the cancellation.
Tom Bruen, 1990 N. California Boulevard, Walnut Creek,
attorney representing Keller Canyon Landfill Company, requested
that the Board cancel the Williamson Act Contract.
Supervisor Fanden moved the cancellation of the
Williamson Act Contract as it pertains to Keller Canyon Landfill.
Supervisor McPeak requested clarification on the issu-
ance of a permit by the Regional Water Quality Control Board.
Charles Zahn, Community Development Department, re-
sponded that the Regional Water Quality Control Board has issued
the waste discharge requirements which is the major policy permit
required by that body.
IT IS BY THE BOARD ORDERED that Resolution 91/621
approving cancellation of Land Conservation Contract 6-71 and a
portion of Land Conservation Contract 8-69 is ADOPTED.

cancellation of Land Conservation Contract No. 6-71 and a portion

The Board of Supervisors of Contra Costa County RESOLVES THAT:
On September 23, 1991, the Keller Canyon Landfill Company,
representing the owners of the properties subject to Land
Conservation Contract 6-71 and the owners of the properties subject
to a portion of Land Conservation Contract 8-69, filed a petition
for the cancellation of the Land Conservation Contract 6-71 and the
aforesaid portion of 8-69. The properties, identified below, are
generally situated south of the. City of Pittsburg and east of
Bailey Road. Their aggregate area is approximately 1,558 acres.
The County Assessor has determined the full cash value of the
properties as though they were free of the contractual
restrictions, and has certified to the Board the cancellation value
of the subject properties for the purpose of determining the
cancellation fee.
The Board hereby determines and certifies to the County
Auditor-Controller that the total amount of the cancellation fee
which the petitioner must pay the County Treasurer is
$2,773,662. 00.
The Board hereby determines and certifies to the County
Auditor-Controller that the amount of the cancellation fee which
the petitioner must pay the County Treasurer for the below-listed
parcels is set forth below.

Total Cancellation Fee: $2,773,662.00
Said amount is 12 .5% of the cancellation value of the subject
properties.
The Board hereby grants approval for cancellation. of Land
Conservation Contract 6-71 as to each parcel listed herein, and the II,
portion of Land Conservation Contract 8-69 identified above as to x
each parcel herein, in accordance with the following conditions and
contingencies:
1. As to each parcel listed herein, the petitioner has paid in �.
full the cancellation fee due under Government Code Section Un
51283 .
2. The petitioner has obtained Board approval of all permits
necessary to commence the Keller Canyon Landfill project.
The Board directs the Clerk of the Board to file with the
County Recorder a Certificate of Cancellation pursuant to
Government Code Section 51283 .4 (b) .

SUBJECT: Letter to Browning Ferris Industries and Waste Management
Company On Local Hiring Priority
On this date having adopted Resolution No. 91/621 approving the
cancellation of Land Conservation Contract 6-71 and a portion of Land
Conservation Contract 8-69 and in conjunction therewith, Supervisor
McPeak moved to write to Browning Ferris Industries and Waste
Management urging them to give first consideration and priority to
hiring locally and to using businesses from this County rather than
going outside the region or state.
Supervisor Fanden seconded the motion.
IT IS BY THE BOARD ORDERED that the Director of Community
Development is DIRECTED to send letters to Browning Ferris Industries
and Waste Management Company urging them to give priority to hiring
locally and using businesses from this County and this region instead
of going out of state.
