SUBJECT: STATE LANDS COMMISSION REPORT ON THE DELTA; POTENTIAL NEED FOR DELTA
REGIONAL -AGENCY
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the following recommendation regarding the recent State
Lands Commission (SLC) Report and potential for a Delta
regional agency.
Proposed resolution of Delta issues should include
consideration of the following:
1. Enforcement of existing law.
2 . New State law to protect all reasonable and beneficial
uses of the Bay-Delta Estuary.
3 . Discussion regarding need for an additional agency
should address appropriate agency structure in order
to minimize duplication of effort.
4 . Any new organization considered should not add a new
layer of bureaucracy; agency priority should consist
of enhancement and coordination with existing
agencies.
2 . Direct the Community Development Department to monitor
relevant legislation as it relates to the SLC and a potential
regional agency.
BACKGROUND/REASONS FOR RECOMMENDATIONS
A report was released by the State Lands Commission in May, 1991
which addresses the many problems occurring within the Delta area.
The report primarily addresses these issues from a public trust
perspective, with public access, recreation and land use as primary
concerns. The report also addresses the myriad of other issues

Potential Need for Delta Regional Agency

(i.e. levees and environmental concerns) affecting the Delta area, and the
inability of the various agencies involved to remedy the problems which arise
because of their actions.
As a result of this report, the State Lands Commission is proposing that a
regional agency be established for the Delta area. Several hearings have been
held, with relevant agencies and legislators invited to present their views. At
the most recent of these hearings, Supervisor Torlakson testified on behalf of
the County, and the Committee for Water Policy Consensus. Supervisor Torlakson
testified that the Board had not yet addressed the need for a regional agency.
Supervisor Torlakson indicated the need for the State to establish statutory
protection for the Bay-Delta Estuary. Lack of guidance at the State level, and
conflicting mandates of state and federal agencies can be seen as resulting in
many of the problems confronting the Bay-Delta area. Supervisor Torlakson also
indicated that consideration of a regional agency should include the Delta
Advisory Planning Council (DAPC) , in some capacity.
DAPC was established by the five Delta Counties to address regional issues within
the Delta. This was accomplished through a joint powers agreement which has been
in place for 18 years. DAPC contends that if a regional agency should be
determined to be necessary, then DAPC should be restructured in order to
accommodate this need.
The Water Committee recommends the above-mentioned policy as it applies to Bay-
Delta issues, and consideration of a regional agency. The Water Committee feels
that a recommendation regarding scope and detail of a regional agency is
premature at this time.
