Authorize 'Chair and Supervisor Schroder to sign a letter (see Exhibit A) ; to Mayor Mercer of Pleasanton, expressing willingness to participate in a joint city/county effort to determine a formula to provide local funding participation for the East Dublin BART station location; and 2 . Direct County Counsel to determine if the Board can establish a fee on new development to help fund transit improvements such as a BART extension. REASONS FOR RECOMMENDATIONS/BACKGROUND: On December 4, 1990, Supervisor Schroder referred a November 20 letter from Mayor Mercer of Pleasanton to the Board of Supervisors. The letter (see Exhibit B) , requests the County to consider developing a formula for assessing a fee on new development that will pay for relocating the proposed Dublin BART station to the east side of I-580 in the vicinity of Hacienda Drive (aka "East Dublin") . According to Mayor Mercer, the estimated total cost of moving the relocation is $18 million. The Board referred this request to the Transportation Committee. The Transportation Committee reviewed Mayor Mercer's proposal- on December 17. The primary benefit to the County of constructing a BART station in East Dublin would- be improved access to BART from the Dougherty Valley. , If the Dougherty Valley were to develop, a potential source of developer fees to help fund the East Dublin station could be generated. However, it is unclear if the County has the ability to impose such fees for transit projects. An opinion from County Counsel is needed before the County could proceed with such a concept. The Board of Supervisors is receptive to the proposal of participating in a joint city/county effort to determine a formula to provide local funding participation for the East Dublin BART station location. The Board's intent is that any County contribution would come from a fee on new development. However, it is unclear if the County has the power to impose such a fee for transit projects since current county fees are limited to bridge and thoroughfare improvements. The Board has requested an opinion from our County Counsel on the ability of the County to impose a developer fee for transit projects such as the one you propose. At PLANNING that time, BART had decided to build two stations in the 484.8023 area but was considering locating the first station at ENGINEERING West Dublin (Stoneridge Mall) rather than in East Dublin 494.8041 (Hacienda Business Park) .' In order to consider building the first station in East Dublin, the local agencies BUILDING INSPECTION were being asked to fund the difference in cost or 494-8015 approximately 18 million dollars. COMMUNITY SERVICES 494-8160 1 asked each City at that meeting last summer whether WATER- BILLING they would consider participating in the cost of 484-8038 relocating the site to the West. Everyone at the meeting indicated a willingness to consider FIELD SERVICES participating in this project. Since that meeting, the 5335 SUNOL BLVD. County contracted with Mel Hing to develop a solution. PARKS An acceptable solution has not been found to date. 494-9056 Unfortunately the solutions that have been considered did not include a possible contribution from each of the SANITARY SEWER Cities and Counties benefitting from the relocation. 494.8061 STREET The Pleasanton City Council is asking you to consider 484-8%6 the possibility of developing a formula (to be assessed SUPPORT SERVICES through development) to relocate the BART station closer 484-8067 to each of your communities and in a 1o* cation which may � WATER better enable a future light rail connection to Contra 484-9071 Costa County. FIRE The formula could be developed to spread the eighteen 4444 RAILROAD AVE. 494.9114 million dollars proportionately to each benefitted City/County.
