In The Matter of Foskett ) RESOLUTION NO. 91/62
General Plan Amendment )
The Board of Supervisors of Contra Costa County RESOLVED that:
There is filed with this Board and its Clerk a copy of
Resolution No. 69-1990 adopted by the San Ramon Valley Regional
Planning Commission discussing an amendment to the County General
Plan for the Alamo area.
On January 22, 1991, this Board held a hearing on said
amendment as discussed by the Contra Costa County Planning
Commission Resolution No. 69-1990. Notice of said hearing was duly
given in the manner required by law. The Board at the hearings
called for testimony of all persons interested in this matter and
numerous people testified in support and opposition of this matter.
The Board hereby finds that the proposed amendment will have
a significant impact on the environment and that a Environmental
Impact Report has been prepared and processed in compliance with
the California Environmental Quality Act and the County EIR
Guidelines.
The Board members, having fully considered this amendment,
determined to amend the Contra Costa County General Plan 1990-2005
from Single Family Residential Very Low Density to Single Family
Residential Low Density and to add wording on the need to buffer
adjacent R-40 , zoned lands.
The Board further directs the County Community Development
Department to incorporate this proposed amendment to said plan into
a combined general plan amendment which this Board will consider
for adoption during the 1991 calendar year as one of the four
permitted amendments to the mandatory elements of the County
General Plan.

SUBJECT: Hearing On Foskett General Plan Amendment, Alamo Area
This is the time heretofore noticed by the Clerk of the .Board of
Supervisors for hearing on the recommendation of the San Ramon Valley
Regional Planning Commission on the request by Mr. Walt Foskett to
amend the County, General Plan from Single Family Residential Very Low
Density (Country; Estates) to Single Family Residential Low Density for
his lands and the Anderson property and with the addition of the Suppe
property located, in the Vernal area of Alamo.
Jim Cutler, Community Development Department, presented the staff
report on the General Plan Amendment request before the Board for
consideration today, and commenting on the request for an additional
twenty or so acres, asking for authorization for a General Plan Study
for a similar kind of change. Mr. Cutler commented on the Planning
Commission denial of the Foskett request.
The public hearing was opened and the following persons appeared
to speak:
Mark Armstrong, P.O. Box 218, Danville, attorney representing the
applicants, spoke in support of the request.
Walt Foskett, 100 Vernal Drive, Alamo, applicant, requested that
the General Plan in his area be changed from Country Estates to Single
Family Low Density.
Jean Foskett, 100 Vernal Drive, Alamo, applicant, spoke on
changes in the area and requested that the General Plan be returned to
Single Family Low Density.
E. Clark Ensley, 1675 Cervato Circle, Alamo, spoke in opposition
to the proposed amendment. .
W.W. Morrison, 80 Jennifer Lane, Alamo, spoke in opposition.
Charles Baker, 410 Vernal Drive, Alamo, spoke in favor of the
proposed General Plan Amendment.
Doris Morehouse, 1110 Douglas, Alamo, spoke in favor of the
proposed amendment.
Tori Lawrence, 110 Fairdale Way, Alamo, President, Vernal Area
Improvement Association, spoke in opposition to the proposed
amendment.
Lawrence R. Petersen, 89 Stephanie Lane, Alamo, spoke in favor of
the proposed amendment.
Halina Repp, 173 Vernal Drive, Alamo, spoke in favor of the
proposed amendment.
Kenneth Repp, 173 Vernal Drive, Alamo, spoke in favor of the
proposed amendment and the proposed study request addressed by Mr.
Cutler.
Charles F. Jarrett, 305 Cross Road, Danville, spoke in favor of
R-40 zoning.
Richard J. Lyding, 167 Oak Road, Danville, Alamo Oaks Homeowners
Association spoke in opposition to the proposed amendment.
Sherry Neely, 20 Flagstone Court, Alamo, Alamo Improvement
Association Planning Committee, spoke in opposition.
David Anderson, 233 Palmer Street, Alamo, spoke in favor.
Cynthia R. Rowland, 95 Stephanie Lane, Alamo, Vernal Area
Improvement Association, spoke in opposition.
Earl Ramer, 86 Stephanie Lane, Alamo, spoke in opposition.
Michael Gibson, 70 Sara Lane, Walnut Creek, Alamo Improvement
Association, spoke in opposition.
Dana Morehouse, 1131 Douglas Court, Alamo, spoke in favor.
Steve Lauck, 151 Vernal Drive, Alamo, spoke in favor.
Janine Rubens, 400 Vernal Drive, Alamo, spoke in ,opposition.
Helen L. Petersen, 89 Stephanie Lane, Alamo, spoke in favor.
Dr. Jeanne LaTorre, 110 Samantha Court, Alamo, Livorna Heights
Homeowners Association, spoke in opposition.
The Chair read cards from the following persons who did not wish
to speak:
Joe Noon, 139 Vernal Drive, Alamo, in favor.
James Cooper,, 1280 Laverock Lane, Alamo, in support of the
proposed amendment and rezoning the Laverock Lane/North Vernal Avenue
Area R-20.
Art Anderson, 111 Jennifer Lane, Alamo, spoke in favor and
commented on people running businesses on property in this area.
Elizabeth Suter, 184 Vernal Drive, Alamo, Vernal Area Improvement
Association, spoke in opposition.
Mark Armstrong spoke in rebuttal.
The public hearing was closed.
Supervisor Schroder commented on this application showing little
significant effect on schools, traffic and utilities. He commented on
the issues including lifestyle, atmosphere, and half acre versus one
acre. He also commented on the orientation of the property to Livorna
Road rather than to the south and the compatibility of half acre
zoning with one acre zoning in this particular area.
Supervisor Schroder advised of his intention to amend the General.
Plan in this particular area to R-20, not setting any precedent for
rezoning property at this time to the south to Jennifer Lane and
Vernal Drive.
Supervisor Schroder questioned whether the rezoning when it comes
back could be conditioned upon endeavoring to maintain the atmosphere
in the area by having the Zoning Administrator review, by limiting
height, by not infringing on privacy of neighbors, and by giving
latitude in the siting of houses on lots.
Jim Cutler responded affirmatively and advised of possible
additional text.
Supervisor Torlakson concurred with Supervisor Schroder' s
comments.
Supervisor Powers commented that this was a difficult decision.
Supervisor McPeak commented on the difficulty of the decision and
expressed support for Supervisor Schroder' s motion.
Supervisor Torlakson requested that the issue of code violations
be referred to the Community Development Department to investigate.
The Board concurred that the Laverock Road. General Plan Study
request be placed, on the January 29, 1991 agenda.
IT IS BY THE BOARD ORDERED that Resolution No. 91/62 determining
to amend the General Plan is ADOPTED; and the Community Development
Department is DIRECTED to prepare the appropriate documentation for
Board consideration on January 29, 1991; and DIRECTED that the
Laverock Road General Plan Study be considered on the January 29, 1991
agenda; and the Community Development Department is REQUESTED to
investigate the issue of code violations.
