SUBJECT: BOGUE RANCH AREA OF BENEFIT FOR ROADS
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
AUTHORIZE the use of $26,412 of road funds for reimbursement to J. Patrick Land Co.
for a portion of the improvements constructed on Livorna road between Trotter Way and
Lavender Drive.
II. Financial Impact:
Road Fund Account #0662 will be decreased by $26,412.
Ill. Reasons for Recommendations and Background:
During the development of the Bogue Ranch Subdivision, off-site road improvements
were conditioned to be constructed by the developer under the premise that the
Bannister and Post properties would financially participate when they were developed in
the future. It was decided to form the Bogue Ranch Area of Benefit as the means for
allocating the costs to the three developing properties.
Prior to adoption of the proposed Area of Benefit, the Banister property developed
without the requirement that they participate in the off-site Bogue Ranch improvement
costs. The Banister Property was required to pay the Countywide Area of Benefit fee of
$2,201 per unit for twelve units. In an verbal agreement between the Community
Development Department and the Bogue Ranch Developer, J. Patrick Land Co.

it was decided that the impact fee paid to the Countywide Area of Benefit would be
transferred to the Bogue Ranch Area of Benefit to compensate for a portion of the costs
lost due to the Bogue Ranch Area of Benefit not being formed in time. However, this
agreement violates the basis of the Countywide Area of Benefit.
Staff recommends against transferring funds from the Countywide Area of Benefit to the
Bogue Ranch Area of Benefit. Staff also recommends that we honor the commitment
made to J. Patrick Land Co. through an equivalent financial participation in the Livorna
Road improvements ($26,412) from the County Road Fund.
IV. Consequences of Negative Action:
A commitment made by staff will not be honored.
