Phil Batchelor, County Administrator ,,'� '� Costa n. $ O: �z County December 13 , 1990 �;,, •� DATE: rrq,c6'un IMPLEMENTATION OF SB 2030 IN CONTRA COSTA COUNTY SUBJECT: SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt the attached Resolution to make SB 2030 (Chapter 433 , Statutes of 1990) effective in Contra Costa County. BACKGROUND- The Contra Costa County Employees Retirement Association' s Governing Board sponsored, and the Board of Supervisors supported, legislation in 1990 to correct a "glitch" which occurred in the law as it relates to counties which are members of the Retirement Act of 1937 . A County employee may purchase specified "public service" , including federal military service, for purposes of calculating the employee' s total years of service for retirement purposes. Among other conditions, the "public service" must be purchased before one retires. Until recently, service in the Merchant Marine was not eligible as "public service" and therefore an employee who had served in the Merchant Marine could not purchase his or her Merchant Marine time. In addition, once the employee retired, he or she could not purchase the time in any case. Recently, the federal ,government made Merchant Marine service during World War II "public service" for retirement purposes. However, the retired employee could not have bought back his or her . Merchant Marine service before retiring because such service was not, at that time, "public service" . This presents a truly "Catch 22" situation! As a result, legislation was carried by Senator Boatwright in 1990 to. permit employees and, retired employees to purchase their Merchant Marine service, if they had served during the specified period of time during World War II . This legislation was approved by the Legislature and. signed into law by the Governor. The law becomes effective January 1, 1991, but can only be effective where a Board of Supervisors votes to make the law effective in that County. Adoption of the attached Resolution will accomplish this and allow any employees or retired employees who are members of our Retirement System to purchase their Merchant Marine service if it occurred during World War II . cc: County Administrator County Counsel Retirement Administrator Director of Personnel Carl Rush, 1356 Grandview Avenue Martinez, CA 94553 1-077 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this order on January 8 . 1991 by the following vote: AYES: Supervisors Powers , Schroder, McPeak, Torlakson, Fanden NOES: None ABSENT: None ABSTAIN: None SUBJECT: Adoption of Government ) RESOLUTION NO. 91/ 18 Code section 31479.3 Providing ) That Public Service Shall Include ) Service in the Merchant Marine ) During World War II. ) WHEREAS prior to the enactment of Government Code section 31479.3, an employee who served in the Merchant Marine during World War II was not entitled to purchase service credit in the retirement system for that service, and WHEREAS Government Code section 31479.3 allows this Board by resolution to allow both members and retired members of the Retirement Association to purchase such .service, NOW, THEREFORE, BE IT BY THE BOARD RESOLVED that the provisions of Government Code section 31479.3 are applicable to the Contra Costa County Employees Retirement Association.
