': o= County DATE: December 24, 1990 cOrrA 6un`�t SUBJECT: IMPLEMENTATION OF SB 2467 IN CONTRA COSTA COUN'T'Y SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt the attached Resolution to make SB 2467 (Chapter 651 , Statutes of 1990) effective in Contra Costa County. BACKGROUND: The Legislature passed a bill in 1990 and the Governor signed it into law which would allow retired employees to return to work. This bill, SB 2467 (Chapter 651, Statutes of 1990 ) is effective January 1, 1991. The Contra Costa County Employees' Retirement Association' s Retirement Board supports implementation of the new law and has urged the Board of Supervisors to implement the law in Contra Costa County. Under current law, there is no provision to allow an employee who has retired to terminate their retirement benefits and return to work. SB 2467 allows this. Under the provisions of SB 2467, an employee who, for whatever reason, decided after retiring that he or she wanted or needed- to return to work could apply to the Retirement Association for permission to do so. If the Retirement Administrator felt it appropriate, she could authorize the"employee to return to work. The employee' s retirement checks would stop and the employee would again begin making contributions to the Retirement Association. The employee would continue to gain additional credit both in terms of years of service and age. The employee could then retire again and benefit from the additional service credits and age at the time of retirement. ylx." County Counsel f Retirement Administrator BY v DEPUTY M382 (10i8Director of Personnel It might, for instance, be that an 'employee retired at a relatively young age and shortly thereafter his or her life style suddenly changed, as for instance, with the death of a spouse. The retiree may well feel that he or she no longer has the desire to be retired without the presence of his or her spouse, may still be in good health and a department may be anxious to have the employee back at work. Likewise, a retired employee' s economic status may have taken a sudden turn for the worse as happened recently with many retired individuals who had invested in "junk" bonds sponsored by savings and loan companies. When the bonds are determined to be worthless, the retiree may feel that he or she can no longer afford to be retired. It might be appropriate for this employee to be allowed to return to employment status. This provision would not, we think, be used very frequently, but it would be available to assist in a situation where it' s use is judged to be appropriate. This provision cannot become effective in a county until the Board of Supervisors adopts a Resolution making the provisions of the new law effective in that County. We are, therefore,, recommending that the Board of Supervisors adopt. the attached Resolution which will make the provisions of SB 2467 effective in Contra Costa County. A summary of the provisions of SB 2467 prepared by the Retirement Administrator for the Retirement Board is attached as further background. THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this order on January 8, 1991 by the following vote: AYES: Supervisors Powers , Schroder, McPeak, Torlakson, Fanden NOES: None ABSENT: None ABSTAIN: None SUBJECT: Adoption of Government ) RESOLUTION NO. 91/19 Code sections 31680.4 and 31680.5 ) Providing for Reinstatement of ) Retired Employees to Employment ) Status. ) WHEREAS the Legislature has enacted Government Code sections 31680.4 and 31680.5 permitting retired employee to be reinstated to active employment status by employers covered by the County Retirement Law of 1937; WHEREAS it is sometimes advantageous to the County and other agencies governed by this Board to reemploy experienced employees; and WHEREAS Government Code sections 31680.4 and 31680.5 allow this Board by resolution to make their provisions. applicable to members of the Contra Costa County Employees Retirement Association: NOW, THEREFORE, BE IT BY THE BOARD RESOLVED that the provisions of Government Code sections 31680.4 and 31680.5 are applicable to the Contra Costa County Employees Retirement Association and its members.
