SUBJECT: LEGISLATION - AB 7 (Floyd)
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Adopt a position in SUPPORT of AB 7 by Assemblyman Richard Floyd
which would make it an infraction for any person of any age to
drive or be a passenger on a motorcycle without wearing a helmet.
BACKGROUND-
In 1989, Assemblyman Floyd introduced AB 8 which would have
required all individuals of any age to wear a helmet when driving
a motorcycle. The bill passed the Legislature but was vetoed by
the Governor, who claimed that the majority of accidents
involving motorcyclists involved individuals under the age of 21.
The Governor indicated that he would sign a bill which required
helmets for drivers under the age of 21.
With the change in Administration, Assemblyman Floyd is again
introducing a motorcycle helmet bill. As introduced, AB 7 would
eliminate the requirement that only drivers and passengers of
motorcycles who are under 15 years and six months of age wear a
helmet and would thereby extend the requirement to all drivers
and all passengers, regardless of age.
