MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: January 8, 1991 SUBJECT: Authorize the Issuance of One Warrant to the U.S. Army Corps of Engineers, for the Walnut Creek Project, Flood Control Zone No. 3B. Project No.: 7520-6138687 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: AUTHORIZE the County Auditor-Controller to issue one (1) warrant for the amount of $118,088.60 payable to the Finance and Accounting Officer, USAED, Sacramento, as a supplemental payment for the District's share of Contributed Funds Other Costs, for the period October, 1990 through December, 1990, for the Walnut Creek Project. The warrant shall be prepared with a reference number and in the amount as follows: Warrant No. 1 Cost Account No. 96X8862-FW197 for $118,088.60 II. Financial Impact: At this time the Flood Control District is required to make a supplemental first quarter FY 1991 payment for the Walnut Creek Project as follows: Contributed funds other (relocations) San Ramon Bypass No. 3 $1181088.60 The warrants shall be funded as follows: ORG. Reasons for Recommendations and Background: By resolution dated January 21, 1958, the Board of Supervisors of Contra Costa County gave assurances of local cooperation to the Corps of Engineers for the Walnut Creek Project. Among these assurances are requirements to pay in cash 7.4 percent of the Federal project construction cost and to provide for the relocation of all roads, bridges and utilities required for the project. The Corps of Engineers has agreed to include relocation work in the Federal project at 100 percent local cost to be paid as a "Contributed Funds Other" item. On August 26, 1986 the Board of Supervisors approved and executed a Joint Exercise of Powers Agreement with the City of Walnut Creek which obligated the Flood Control District to pay 7.4 percent of the cost of channel cover funded by the City and included in the Federal project as a "Contributed Fund Other" item. On October 9, 1990, the Board of Supervisors approved payment for two (2) warrants totaling $224,955.66 for the period October, 1990 through December, 1990, as requested by the Corps of Engineers at that time. However, the Corps of Engineers had not accounted for all costs payable for this period and has requested this supplemental payment. IV. Consequences of Negative Action: Failure to authorize the issuance of a warrant would be cause for the Corps of Engineers to stop further work on the Walnut Creek Project.
