Authorize the Community Development Department to send letters to reclamation districts requesting their input on funding provisions to facilitate relocation of structures encroached upon levees. 2 . Request the Growth Management and Economic Development Agency to explore the feasibility of making Bethel Island a Redevelopment area, and report to the Water Committee. 3 . Request the Community Development Department to review .. and respond to all comments regarding the proposed public access policy, revise policy accordingly, and report back to the Water Committee. 4. Direct the County Administrator Office to forward proposed legislation for funding;to reestablish the Sheriff Marine Patrol to the County Legislative. Delegation and to communities within the Delta area. 5.1 Authorize the Community Development Department to submit comments on the Delta Wetlands project with direction from the Water Committee. Authorize Chair to sign letters to relevant agencies indicating County concern with dumped debris at. McAvoy harbor, and lack of agency intervention. 6b. Direct Public Works, Building Inspection, Community Development, the Fish and Wildlife Committee, and the West Pittsburg Management Area Committee to review any applications for development .within the McAvoy Harbor area. FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS 1. SB-34, the Delta Flood ,Protection Act, provides for funding to develop and implement flood control projects on the eight western Delta islands,. which are critical to water quality. Levee improvement or rehabilitation efforts will require modification to the existing levees' to a large degree. Many structures on Bethel Island and several structures on Hotchkiss Tract were built on levees, which interferes with levee stability detection, and future levee improvements. The Department of Water Resources has determined that in order to build levees to safe standards, encroached structures will need to be moved. The Water Committee has recommended that the respective reclamation districts research potential funding sources by which to accomplish relocation of these structures. Currently, no funding source is identified to aid in costs of relocation. 2 . A preliminary assessment was done at one time by the County Redevelopment Agency to determine if the Bethel Island area could be categorized as a redevelopment area. Some questions arose as to the feasibility of such an action, (due to financial considerations and open space requirements) , and this possibility met with unfavorable community reaction at that time. The Water Committee requests that a full feasibility report be prepared, as the tax increment from redevelopment would be an important funding source for this community. 3 . The issue of a (proposed) public access policy for the County has been somewhat controversial. Reclamation Districts and landowners in the Delta area have many serious concerns regarding public access as it affects their property, liability, levee stability and maintenance, funding and other issues. Many comments, letters and a petition were received by the Water Committee during their January 28, 1991 meeting. The Water Committee recommends that policy be revised, resubmitted to the Water Committee at a later date, and comments be answered by staff. 4 . In September, 1989 the Sheriff Marine Patrol was cut by approximately 80% due to County budgetary constraints. In an effort to obtain additional funding for this important function, the Board directed the County Administrator Office to pursue legislation to increase the boater registration fee by $7 to reestablish a Marine Patrol contingent. The Water Committee requests that the County Administrator send draft legislation to the entire County Legislative Delegation, and to cities and counties in the Delta area in order to enlist support for this legislation. 5. The .Water Committee has recognized several important- issues which will need to be addressed regarding the proposed Delta Wetlands Project. The Fish and Wildlife Committee also has concerns, and had requested that this issue not appear on the Water Committee agenda until the February, 1991 meeting. The Water Committee meeting is tentatively scheduled for February 25, '1991, which will enable comments to be submitted to State Water Related Issues Continued - Page. Three and Federal .agencies prior to the February 28, 1991 deadline for comment submittal. 6. Several public agencies have been notified over a year ago that the McAvoy harbor area has been used as a dumping ground. Very little progress has been made since that time to clean up rotting barges and debris at the Harbor. Debris clogs a channel that was created (and deeded ` to the State Lands Commission) as a_' mitigation measure for impacts caused by harbor dredging. The channel was designed to increase flow to a marsh surrounding McAvoy harbor. The Water Committee recommends that letters be sent to the Bay Conservation and Development Commission, the Army Corps of Engineers, the East Bay Regional Park District, and the State Lands Commission indicating County concern, and requesting that corrective. action be .taken. In addition, the Water Committee recommends that any County permit actions for McAvoy harbor be scrutinized by the above-mentioned County departments and committees prior to approval.
