Amend the Board' s orders of December 4, 1990 and January 15, 1991 regarding the composition of and appointments to the Marsh Canyon Landfill Citizens' Advisory Committee to make the following changes in the composition of the Committee: * Remove the Human Services Provider * Add as a Non-voting seat, Waste Management of North America 4 . As requested by the City of Brentwood, amend the Board' s order of January 15, 1991 making appointments to the Marsh Canyon Landfill Citizens' Advisory Committee to substitute for Art Gonzales as the representative of the City of Brentwood: William Doheney 700 Timberline Terrace Brentwood, CA 94513 BACKGROUND: On December 18, 1990, the Board of Supervisors referred to the Internal Operations Committee a proposal for the formation of a Local Advisory Committee for the Keller Canyon Landfill. Community Development Department staff have reviewed the proposal and have suggested some changes to make it as parallel as possible to the recently formed Marsh Canyon Landfill Citizens' Advisory Committee. Their recommendations are contained on the attached report to our Committee. In addition, the City of Pittsburg raised a number of concerns regarding the original proposal. Most of those concerns had already been addressed in the staff report. The city of Pittsburg is still recommending that a seat be provided for BART. We agree and also believe that there is no basis we can discern for having a human services provider on the Committee. We have, therefore, deleted that seat and have added a seat for the Bay Area Rapid Transit District and a non-voting seat for Browning-Ferris Industries. In order to try to maintain as parallel as possible a structure between the Marsh Canyon and Keller Canyon Landfill Committees, we are also suggesting the the human services provider position be eliminated for the Marsh Canyon Landfill and the Waste Management of North America be added as a non-voting seat. -2- CONTRA COSTA COUNTY COMMUNITY DEVELOPMENT DEPARTMENT DATE: January 17, 1991 FILE: R-25G-2 TO: Internal Operations Committee Supervisor Schroder Supervisor McPeak FROM: Charles A. Zahn, Assistant Director By: Vicki Conklin, Planner SUBJECT: FORMATION OF LOCAL ADVISORY COMMITTEE; Keller Canyon Landfill Project RECOMMENDATIONS: Composition of the Keller Canyon Landfill Local Advisory Committee (LAC) be modelled after the organizational representation adopted by the Board of Supervisors on 11/26/90 for formation of the Marsh Canyon Landfill LAC. * Recruitment for the Human Services appointees be conducted simultaneously for both LACs, utilizing a press release and letter requesting nominations from County Human Services Committees. BACKGROUND: On 11/26190 the Board of Supervisors adopted structures for formation of the Local Advisory Committee for the Marsh Canyon. Landfill project. Supervisors Fanden and Schroder have since presented.a composition of organizations for the Keller Canyon LAC which are similar to, but more specific than those used for the adopted Marsh Canyon model (see attachment). These organizations were used as the core of staff's recommendations and broadened to allow the Keller.Canyon LAC to more closely resemble the LAC for the Marsh Canyon project. For example, staff recommends that the category of "Pittsburg Chamber of Commerce" be expanded to cover representatives of the Chamber of Chambers and the Industrial Association. As shown on the attached table, it is further recommended that additional categories of appointees be added to the Keller Canyon LAC to reflect the adopted model used for the Marsh Canyon LAC. While Supervisors Fanden and Schroder recommended that staff of the Community Development Department and a representative from the landfill developer serve on the LAC, we suggest it may be preferable to have Community.Development staff the LAC meetings, and invite the landfill developer to attend meetings in their capacity as project developers. This seems to-be consistent with the Land Use.Permit Conditions of Approval (11.2), which allows the advisory group's operations (staffing) to be funded by a surcharge on the tipping fee. In order to fill the position .for.a representative of a Human Services Provider for the Marsh Canyon LAC, the IOC directed staff at its 1/7/91 meeting to utilize a press release. Since both LACs have openings for this position, staff recommends that in addition to a press release, appropriate County Committees be contacted for nominations,-and recruitment for both positions occur simultaneously.
