SUBJECT: REAFFIRM OFFER OF ASSISTANCE TO THE SUPERIOR COURT IN REGARD
TO CONCERNS ABOUT THE COUNTY PROBATION DEPARTMENT
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)8 BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Reaffirm the Board' s offer to provide assistance to the Superior
Court in addressing the concerns which have been identified
regarding the County Probation Department.
BACKGROUND:
A Management Audit conducted by KPMG Peat Marwick in the Spring
of 1990 identified issues and concerns within the Probation
Department. The Juvenile Justice Commission released a report in
January, 1991 identifying problems within the Department which
they have observed. The present and past Grand Juries have
issued reports on the Probation Department.
The County Administrator and the Board of Supervisors have
offered their services and have, in fact, provided financial
resources to assist in identifying areas of concern. The Board
of Supervisors provides the Probation Department with fiscal and
personnel resources to carry out its work. However, the Board of
Supervisors and County Administrator have little or no
jurisdiction over Probation Department operations.

Therefore, other than offering advice or assistance, the Board of
Supervisors has no ability to change the day-to-day management of
the Probation Department.
We, therefore, recommend that:
* the main concerns be identified by the Superior Court from
the reports, audits and studies noted above,
* that the Probation Department management and employees, and
the agencies having oversight authority of the department,
be encouraged to reach agreement on the definition of the
issues and how they should be addressed,
* the Probation Department employees and the employee
organizations which represent them sit down with the
management of the Department, identify each of the issues,
discuss and hopefully reach consensus on an appropriate
resolution of each issue and then move ahead to implement
.each solution.
As a part of this effort, the Board of Supervisors should
reaffirm its offer to provide assistance to the Superior Court in
working through the problems of the Probation Department.
However, it is important to bear in mind that neither the County
Administrator nor the Board of Supervisors are in a position to
impose their advice or suggestions on the Superior Court or the
Probation Department.
We have been advised that the Superior Court is preparing an
Action Plan and a process by which to address these issues. We
understand that this Action Plan is still in the process of being
developed.
