SUBJECT: REPORT ON HOST COMMUNITY MITIGATION IN THE ARTHUR ROAD AREA OF
VINE HILL
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS•
1. Request the Community Development Director, in conjunction
with the Sheriff-Coroner, to attempt to satisfactorily
resolve with the Martinez Gun Club and the residents of the
Arthur Road area, the identified problems with enforcement
of the Conditions of Approval for the Land Use Permit for
the Acme Transfer Station and report back to our Committee
regarding this matter on March 25, 1991.
2 . Direct staff from the Community Development Department to
work with ACME and Deloitte-Touche to develop the costs of
the mitigation measures and develop a related fee structure.
Once this information has been developed it should be
reviewed with the Host Mitigation Committee and then
returned to our Committee. It will be necessary to develop
a recommendation to the Board of Supervisors on how the host
community mitigation will be handled, either as a reduction
in the fees paid by the residents immediately adjacent to
the ACME site (resulting in a higher rate for all other
rate-payers) or in the accumulation of a fund of cash which
can then be used to purchase something for the community
which is desired and needed by the community. This item
should be returned to our Committee on a date agreed to
between staff from the Community Development Department and
County Administrator' s Office.

BACKGROUND:
This item was brought to the Board' s attention through a letter
from Dorothy Sakazaki to the Solid Waste Commission, which was,
in turn, referred by the Solid Waste Commission to the Board of
Supervisors. The Board referred the item to our Committee. The
attached staff report, which identifies the issues and background
on this item, is incorporated into this report by reference.
On February 11, 1991 we met with staff from the Community
Development Department, Dorothy Sakazaki, and representatives
from the Sierra Club and reviewed the attached report.
Obviously, the issue of host mitigation can become an extensive
and expensive one, given the existing landfills in the County and
the likelihood of two additional sites in the near future. Since
this is the first case in which we have attempted to resolve the
host community mitigation issue, it is important that the process
used be a sound one which can be replicated in other communities
in the future.
The enforcement problems which are outlined in the attached
report can be addressed fairly quickly with the Sheriff, the
Martinez Gun Club and the area residents.
The actual amount to which the community should be credited will
require some extensive discussions between ACME, County staff,
Deloitte-Touche and the area residents in order to calculate an
accurate figure and then determine the most appropriate method of
providing mitigation to the community.
The above recommendations are intended to. address both of these
issues and continue the progress which has been made to date in
this area.

SUBJECT: Host Community Mitigation--Vine Hill Area
Under Ordinance No. 89-81 - Process for Determining Compensation to
Impacted Communities as Mitigation for Waste Diversion, the
residents of the Vine Hill Area identified three ( 3 ) problems
requiring mitigation and requested compensation in the form of
reduced solid waste/recycling fees. At this time, the Vine Hill
Area Host Mitigation Committee is comprised of Dorothy Sakazaki,
Dave Contreras from the Vine Hill Sanitary District, and ACME.
Outlined below is the status of the items raised by Mrs. Sakasaki in
behalf of the Vine Hill residents.
Status of Identified Problems
The three problems identified were ( 1 ) traffic impacts, ( 2) litter,
and ( 3 ) noise. Mitigations for these problems are included in the
Conditions of Approval. Specifically, ( 1) closure of Arthur Road
and its signing have been completed to mitigate both transfer
related traffic and litter; the construction of a sound wall and use
of receptors are intended to mitigate noise.
While it is agreed that the Conditions of Approval do mitigate the
identified impacts, a continuing problem exists with enforcement.
Because the Gun Club apparently does not adequately maintain the
gate closure, traffic and litter remain a problem. Additionally,
highway/roadway construction debris is still accummulating on the
right of way at Waterfront Road. Because these are mainly
enforcement issues at this time, the Community Development
Department will review the agreement with the Gun Club and will
seek to take appropriate enforcement action, and will contact Public
Works staff to alleviate the disposal of construction debris.
On-going review of noise, traffic, and so forth is under the purview
of the Local Advisory Committee, as required by the Conditions of
Approval. The Local Advisory Committee is being formed and will be
comprised of Mrs. Sakasaki, a resident living on Irene Drive, a
representative of the Gun Club, Dave Contreras from the Sanitary
District, and both the County and ACME.
Status of Host Mitigation Compensation
Determining the appropriate compensation for the Vine Hill residents
requires both that the costs of the mitigations be calculated and
that the County request Deloitte-Touche to prepare a related fee

structure. The Community Development Department is beginning work
with ACME and Deloitte-Touche to derive the necessary data; this
information will be reviewed with the Host Mitigation Committee and,
then, with your Committee. The Vine Hill representatives have asked
that either the Host Mitigation Committee or the Local Advisory
Committee be given the authority to identify how the costs will be
dispersed and/or used for the Vine Hill community.
ACME has raised the point that future Host Mitigation costs related
to the two new landfills may, ultimately, increase fees paid by Vine
Hill residents. Without causing unnecessary delay for implementing
a Host Mitigation for Vine Hill, Community Development staff want to
explore with Deloitte-Touche the possible implications of future
Host Mitigation costs on the countywide fee structure.
