MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: February 26, 1991 SUBJECT: BRENTWOOD ROAD OIL AND GAS LEASE, BRENTWOOD AREA Project No.: 0674-6U4200 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE Subsurface Oil, Gas and Mineral Lease with Nahama & Weagant Energy Company and AUTHORIZE the ,Board Chair to sign said lease on behalf of the County. . III. Financial Impact: The proposed Lessee has paid a $250 processing fee to the County. The lease provides for a$50 per acre rental fee and a one-fourth royalty on production, if any. The primary term of the lease is for 5 years. 111. Reasons for Recommendations and Background: The lease is basically for the production of natural gas located under a 3.024 acre portion of Brentwood Road near Brentwood. No surface rights are involved. The State Lands Commission on February 6, 1991 approved this lease for exemption from competitive public bidding requirements pursuant to Sections 7052 and 7053 of the California Public Resources Code. CEOA and General Plan Conformance requirements were complied with during the approval process for the off-site well drilling location. IV. Consequences of Negative Action: Loss of revenue as outlined in Section II above. Recommended Action: ACCEPT areas dedicated to public use for Empire Avenue as shown on the following subdivision maps: 1. Subdivision 6980 "Orchard View Unit 2" filed September 8, 1989, in book 337 of Maps at page 15. 2. Subdivision 6996 "Amberwood I" filed February 23, 1990, in Book 342 of Maps at page 17. 3. Subdivision 6867 "Orchard View Unit 1" filed September 8, 1989, in Book 337 of Maps at page 19. II. Financial Impact: No costs involved. III. Reasons for Recommendations and Background: These offers of dedication were obtained as conditions of approval for the above referenced subdivisions and are needed for the Empire Avenue road widening project in accordance with approved plans and specifications. IV. Consequences of Negative Action: The project will not have sufficient land rights to allow for construction in accordance with approved plans and specifications.
