SUBJECT: LEGISLATION - AB 402 (Felando)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)6 BACKGROUND AND JUSTIFICATION
RECOMKENDATION
Adopt a position in SUPPORT of AB 402 by Assemblyman Felando,
which would substantially prohibit all smoking in all public and
private buildings which are open to the public.
BACKGROUND:
Current law places a number of different kinds of restrictions on
smoking in various types of buildings, generally along the line
of providing separate rooms or areas for smokers and non smokers.
Assemblyman Felando has introduced AB 402 which would repeal many
of these existing partial restrictions and do all of the
following:
* Adopt legislative findings regarding the dangers of second
hand smoke.
* Prohibit smoking in all publicly and privately owned
buildings which are open to, used by or accessible to the
general public.
* The definition of "publicly and privately owned building"
includes, but is not limited to, health clinics, health

facilities, food facilities, the office of any healing arts
professional, retail store, teacher' s lounge in an
educational institution, indoor and open-air theater, indoor
and open-air auditoriums, waiting rooms of transportation
services and indoor and open-air stadiums.
* Signing is required, noting that smoking is not permitted in
the facility and noting that a violation is punishable with
a fine of $50 for the first offense and $100 for each
subsequent offense. As an alternative to the signing, food
facilities may place a a small sign on each table with this
same message.
* Provides for a $50 fine for a first offense and a $100 fine
for each subsequent offense of violating any provision of
the law.
AB 402 would appear to be consistent with previous positions
taken by the Board of Supervisors in terms of discouraging
smoking and in providing additional restrictions on smoking
within public and private buildings in this County. It is,
therefore, recommended that the Board of Supervisors indicate
their support for AB 402 .
