SUBJECT: Approve Payment Plan for Contribution to a Signal Controller Required by Land Use
Permit (LUP) 2086-88, Pacheco Area - project #4660-6X3022
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE payment plan for $15,000 contribution to a signal controller required by Land Use
Permit (LUP) 2086-88.
11. Financial Impact:
Payment of $15,000 owed to County Road Fund will be collected.
111. Reasons for Recommendations and Background:
Bruce Garner, dba Run Burger Run at the corner of Pacheco Boulevard and Center Avenue in
Pacheco, obtained Land Use Permit (LUP) 2086-88 in 1988 to construct the hamburger retail
outlet. Condition No. 13-B-3 of LUP 2086-88 required that he contribute $15,000 towards a new
signal controller and cabinet in order to more efficiently operate the signals at Pacheco
Boulevard and Center Avenue and mitigate traffic impacts caused by his development.
The County installed the new equipment on June 27, 1989. At the time Garner obtained Land
Use Permit, he was told by Public Works staff that the signal controller would be capable of
operating the signals in a manner described as "4-way." The "4-way" operation would permit
splitting the signal phase for Center Avenue traffic by requiring each leg of Center Avenue traffic
to obtain the green light separately. Separating this signal phase would significantly increase
safety for motorists turning left out of Center Avenue. Land Use Permit #2086-88 was
conditioned to pay for this improvement.

Originally, staff felt it would be more cost effective to reprogram this signal and change it to the
"4-way" operation in conjunction with the County's proposed project to widen Center Avenue
easterly of Pacheco Boulevard. However, on August 22, 1990, Public Works Traffic Signal
Technicians reprogrammed this signal and the signal is currently operating as a "4-way" signal.
The County has completed its obligation to reprogram the signal as was intended in Condition
#13-B-3 for Land Use Permit #2086-88.
The intent of the Conditions of Approval were that Garner should pay the $15,000 contribution
prior to opening his business. However, he did open it for business and since that time the
County has been trying to collect the overdue payment.
At a February 6 meeting, the Public Works Director agreed to recommend a payment schedule
to the Board of Supervisors which provides for payments of$2,500 due on March 1, 1991, April
1, 1991, and May 1, 1991. The balance of $7,500 will be due within 30 days after receipt of
billing by the Public Works Department,with the understanding that the$7,500 billing will be sent
no later than the date which the Board of Supervisors advertise for bids for the widening of
Center Avenue, easterly of Pacheco Boulevard.
IV. Consequences of Negative Action:
Overdue payment of $15,000 will revert back to the County Collections Office for appropriate
action.
