THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on February 12, 1991 , by the following vote:

SUBJECT: Wildcat/San Pablo Creeks Project Delays
The Board received the attached report dated February
12, 1991 from J. Michael Walford, Public Works Director, responding
to a letter from Francis Aebi relative to the delay in completing
the Wildcat/San Pablo Creeks Flood Control Project. Milton
Kubicek, Deputy Public Works Director, Flood Control, stated that
the project cannot be completed until funding is received from the
State Flood Control Project Subvention Program.
Lina Hale, 509 Brookside Drive, Richmond, referred to
the formation of Assessment District 1982-2 and noted that the
assessments had been very costly for some area property owners'.
She stated that while Flood Control staff has advised that property
owners below the tracks are protected by the work that has been
completed, residents still have concerns about debris upstream and
the potential for flooding. Ms. Hale urged the Board to do
everything possible to obtain the necessary funding from the State
Subvention Program in order to complete the project.
Supervisor Tom Powers recommended that Flood Control
staff research the issue of the- State ' s obligation to fund the
Subvention Program projects and the feasibility of the Flood
Control District borrowing money from the Redevelopment Agency, to
be repaid when the Subvention funds are received. He requested
that a meeting be scheduled with community and city representatives
and the County' s Legislators to attempt to resolve this matter.
Board members being in agreement, IT IS ORDERED that the
following actions are- APPROVED:
1) ACCEPTED report from Public Works Director relative to
delays on the Wildcat/San Pablo Creeks Project;
2) REQUESTED Public Works Director to review the State' s
obligation to fund the Flood Control Project Subvention
Program, and the feasibility of borrowing funds based on
potential payment from the State; and
3) REQUESTED Public Works Director to schedule a community
meeting as soon as possible with the County' s
Legislators, City Council representatives and residents
of the Project area.

I. Recommended Action:
ACCEPT this report from the Chief Engineer regarding the letter from Mr. Francis Aebi about
delays on the Wildcat/San Pablo Creeks Project, and
DIRECT the Chief Engineer to pursue any potential sources of funding to finance the non-
Federal costs required to complete these segments, and
CONFIRM the Board's intent to pursue completion of the project when adequate funding for the
non-Federal share is available.
II. Financial Impact:
Additional local funding will have to be developed.

III. Reasons for Recommendations and Background:
On August 3,1982,the Board formed Assessment District 1982-2 (AD82-2) for financing the local
share of the non-Federal costs required to construct Phase I (Reach 1) of the Wildcat/San Pablo
Creeks project (Resolution. 82-873). The Assessment District boundaries were generally
described to extend from Giant Highway westerly to San Pablo Bay Marsh.
Contracts 1 and 2 of the Corps of Engineers' improvements have been completed, effectively
removing the areas downstream of the Southern Pacific railroad tracks from the 100 year flood
plain. The Corps of Engineers' proposed Contracts 3 and 3A will complete the remaining
improvements for Reach I. Contract 3 will complete Wildcat Creek from just downstream of the
Southern Pacific railroad tracks to just upstream of the Atchison, Topeka and Santa Fe railroad
tracks. Contract 3A will complete San Pablo Creek from just downstream of the Southern Pacific
railroad tracks to just upstream of Giant Highway (upstream of the Atchison, Topeka and Santa
Fe railroad tracks). Upon completion of Contracts 3 and 3A, the flood control improvements for
which Assessment District 82-2 was formed would be complete. The Corps of Engineers is
currently preparing the plans and specifications for Contracts 3 and 3A.
The non-federal costs for this project are funded 30% from local funds and 70% from the State
of California Federal Flood Control Project Subvention Program. The Subvention Program was
not funded in this years' State Budget. Consequently, the State of California is obligated to pay
the District approximately $800,000 for FY 1989-90 cost and $200,000 for FY 1990-91 costs.
Right-of-Way acquisition, utility relocations, and construction of Contracts 3 and 3A cannot begin
until the Subventions Program is funded since local funding is insufficient to makeup the loss
of Subventions funds. Last November's ballot contained a Water Resources Proposition that
would have provided subventions money for Contracts 3 and 3A. Unfortunately it was turned
down by the voters. The Corps of Engineers is proceeding with design, however.
We hope that the Subventions Program will be funded in Fiscal Year 1991-1992. If it is, Right-of-
Way acquisition and utility relocations can then begin, with construction probably commencing
in the Spring 1992. Although land located downstream of the Southern Pacific railroad tracks
is no longer in the 100 year flood plain, it is the desire and commitment of the Contra Costa
County Flood Control and Water Conservation District to pursue completion of Reach I.
IV. Consequences of Negative Action:
There could conceivably be additional delays in completion of the remainder of Reach I channel
improvements.
