(LAFC 90-63) )
WHEREAS, Section 99 of the Revenue and Taxation Code provides that a
jurisdictional change resulting from a special district providing one or more
services to an area where such services have not been provided previously shall not
become effective if one or more affected special districts involved in the property
tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and
WHEREAS, the Board of Supervisors shall determine the property tax exchange for
each affected district that fails to adopt a resolution agreeing to a property tax
transfer for the annexing district; and
WHEREAS, the Contra Costa Water District is the only affected agency in the Mira
Vista 89-4 Boundary Reorganization that isnot a party to an existing property tax
transfer agreement and the District has requested that no property tax be exchanged
as a result of the annexation.
NOW,. THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA
COUNTY HEREBY DETERMINES that no property tax will be transferred to the Contra Costa
Water District as a result of annexing the territory described in the Mira Vista 89-4
Boundary Reorganization. This resolution does not change the property tax revenue
accruing to other agencies serving the subject territory or the affected districts'
right to collect taxes for existing bonded indebtedness. The property tax exchange
agreement discussed above shall apply to affected. territory as submitted or revised
by the Local Agency. Formation Commission.

to Oakley Sanitary District )
(LAFC 90-55) )
WHEREAS, Section 99 of the Revenue and Taxation Code provides that a
jurisdictional change resulting from a special district providing one or more
services to an area where such services have not been provided previously shall not
become effective if one or more affected special districts involved in the property
tax exchange negotiation fails' to adopt a resolution agreeing to a transfer; and
WHEREAS, the Board of Supervisors shall determine the property tax exchange for
each affected district that. fails to adopt a resolution agreeing to a property tax
transfer for the annexing district; and
WHEREAS, Annexation No. 90-4 to Oakley Sanitary District (LAFC 90-55) involves
the annexation of territory to the Oakley Sanitary District and the . District has
agreed that no property tax will be exchanged as a result of the annexation; and
WHEREAS, the Local Agency Formation Commission Executive Officer has recommended
that the annexation be revised to include the annexation of territory to the Contra
Costa Water District and the Oakley Water District and both Districts have agreed
that no property tax will be exchanged as a result of this annexation.
.NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA
COUNTY HEREBY DETERMINES that no property tax will be transferred to the Oakley
Sanitary District, the Contra Costa Water District or the Oakley Water District as a
result of annexing the territory described in Annexation No. 90-4 to Oakley Sanitary
District (LAFC 90-55) . This resolution does not change the property tax revenue
accruing to other agencies serving the subject territory or the affected districts'
right to collect taxes for existing bonded indebtedness. The property tax exchange
agreement discussed above shall apply to affected territory as submitted or revised
by the Local Agency Formation Commission.
