Public Employees Union Local 1, of legislation which would make it possible for Animal Control Officers to be provided safety retirement and which would allow the Board of Supervisors to negotiate with Local 1 over the terms and conditions under which the Board of Supervisors would agree to provide Animal Control Officers with safety retirement. BACKGROUND: One of the items in the Board' s 1990 Legislative Program was the passage of legislation which was jointly sponsored by the Board of Supervisors and Public Employees Union Local 1, which would authorize the Board of Supervisors to negotiate with Local* l the terms and conditions under which Probation Officers would be provided safety retirement. State Law already provides that safety retirement could be extended to Probation Officers and group counselors with the approval of the Board of Supervisors. However, the law did not clearly provide for the employee to agree to pay the increased costs which would otherwise have to be borne by the employer in order to provide such safety retirement status. Local 1 is seeking such legislation and is asking the Board of Supervisors to jointly sponsor such legislation with Local 1. If the law is amended in order to provide for the possibility that Animal Control Officers could be extended . safety . retirement, then the language regarding negotiating the terms and conditions of that safety retirement would automatically apply to Animal Control Officers as well. The argument which is used in support of safety retirement for Animal Control Officers is that they are increasingly being asked to accompany law enforcement officers when the officers "bust" an illegal drug laboratory. Frequently the individuals who are operating the illegal laboratory use dogs to guard their property, making it more difficult for law enforcement officers to enter the property and seize the individuals and/or evidence of illegal drug manufacturing. In order to deal with this situation, law enforcement officers are increasingly asking that Animal Control Officers accompany them in these cases. Since Animal Control Officers are exposed to this additional danger, in many cases equal to that faced by law enforcement officers, it is felt that safety retirement is appropriate for Animal Control Officers. cc: County Administrator Harry Cisterman, Director of Personnel Pat Wiegert, Retirement Administrator Mike Ross, ASO, Animal Services Department Henry Clarke, General Manager, Local 1 Les Spahnn, SRJ.
