SUBJECT: HEARING ON THE APPEAL OF THE DENIAL OF THE VESTING TENTATIVE MAP FOR
MINOR SUBDIVISION 109-90 - BETHEL ISLAND AREA.
SPECIFIC REQUESTS) OR RECOMMENDATION(S) i BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Deny the appeal filed by Charles Frank Pringle, Jr. with
respect to inconsistency with the Bethel Island Area Specific
Plan for Minor Subdivision 109-90.
2 . Alternatively: Grant the appeal filed by Charles Frank
Pringle, Jr. with respect to inconsistency with the Bethel
Island Area Specific Plan for Minor Subdivision 109-90 and
return the application to staff to complete CEQA.
BACKGROUND
The background for this project is reviewed in the August 12, 1991
staff report to the East County Regional Planning Commission. The
Commission reviewed an appeal of the Zoning Administrator's denial
of the application filed by the applicant/owner, Charles Frank
Pringle, Jr. Mr. Pringle is objecting to the Zoning
Administrator's decision of denial based on the inconsistency of
the project with the Bethel Island Specific Plan adopted by the
Board of Supervisors on July 10, 1991.
On August 12, 1991, after taking testimony, the Planning Commission
voted to deny Mr. Pringle's appeal, and uphold the Zoning
Administrator's denial of the project.
On August 18, 1991, the applicant/owner of the property, Charles
Frank Pringle, Jr. , appealed the Commission's decision to the
Board.
Mr. Pringle's appeal contains no new information th s no
available to the Commission.

This is the time heretofore noticed by the Clerk of the
Board of Supervisors for hearing on the appeal of Charles Frank
Pringle, Jr. (appellant) from the decision of the East County
Regional Planning Commission acting as the Board of Appeals on the
request by Charles Frank Pringle, Jr. (applicant and owner) for
approval of a Vesting Tentative Map (MS 109-90) to divide 6 acres
into 4 lots in the Bethel Island area.
Mary Fleming, Community Development Department, pre-
sented the staff report on the appeal and described the project
site. She commented on the staff recommendation that the Board
uphold the decision of the Zoning Administrator and the East County
Regional Planning Commission and deny the appeal with respect to
the inconsistency of the Bethel Island Specific Plan as well as the
A-2 zoning.
Victor Westman, County Counsel, advised that this
application had been processed without CEQA compliance and ad-
dressing the zoning variance questions.
The following person appeared to speak:
Charles F. Pringle, Jr. , P.O. Box 474, Bethel Island,
appellant/applicant/owner, commented on his grounds for appeal
including the time limit in the Subdivision Map Act for approval or
disapproval of the map, whether the Bethel Island Specific Plan
applied to this application, and compliance with zoning.
Supervisor Powers questioned whether the Specific Plan
applies or not.
Mary Fleming responded that the application that was
submitted by Mr. Pringle was determined to be incomplete and by the
time it was complete, the Bethel Island Specific Plan was in
effect.
Victor Westman responded on the issue of automatic
approval.
Dennis Barry, Community Development Department, com-
mented that he had advised Mr. Pringle that even if the specific
Plan did not apply, then he still had to contend with the zoning
requirements.
Mr. Pringle commented that he did not believe that he
-was bound by the Specific Plan.
Supervisor Torlakson requested clarification on why the
application was deemed incomplete.
Ms. Fleming responded that it needed an archeological
study, the indications of the roads and streets, an indication of
the drainage and how that is being provided, complete dimensioning,
. and adjoining property owners gross net acreages.
The public hearing was closed.
Supervisor Torlakson moved to deny the appeal and
support the staff recommendation.
IT IS BY THE BOARD ORDERED that recommendation 1 is
APPROVED.
