' County DATE: November 12, 1991 ` SUBJECT: Bingo, Cardroom, and Massage Services Pees SPECIFIC REOUEST(S)OR RECOMMENDATION(S)S BACKGROUND AND JUSTIFICATION RECOMMENDATION: Approve the fees set forth on the attached 'Exhibit A pursuant to Ordinance Code section 18-2 . 002 . FINANCIAL IMPACT: With the Board of Supervisors '• adoption of the fees proposed on Exhibit A, the Sheriff ' s services necessary for the administration and enforcement of the bingo, Cardroom, and massage services ordinances will more accurately reflect and provide for actual and necessary enforcement and administration costs . REASONS FOR RECOMMENDATION/BACKGROUND: \ 1 . The Sheriff presently cannot inspect, monitor, or take enforcement action in Contra Costa County' s cardrooms , bingo parlors , and massage parlors because his personnel have been further reduced in the recent budget process . 2 . The Sheriff cannot abdicate his responsibility to regulate gaming to the State of California because the State is not able to fill that void and will not inspect, monitor, or take enforcement actions in local cardrooms., bingo parlors , and massage parlors . 3 . There is a pressing need for trained law enforcement personnel to conduct regular inspections at local cardrooms, bingo parlors , and massage parlors . Analysis of the fee structures in the current bingo, cardroom, and massage services ordinances indicates that the costs to the County for providing the Sheriff ' s services .necessary for administration and enforcement of these ordinances should be adjusted to more accurately reflect actual and necessary costs . 5 . The adoption of the proposed fees will provide the County with the revenue needed to inspect, monitor, and take enforcement action in cardrooms , bingo parlors , and massage parlors . CONSEQUENCES OF NEGATIVE ACTION: If the Board does not approve the fees set forth on the attached Exhibit A, the Sheriff will not be able to perform his legal responsibilities regarding cardrooms, bingo parlors , and massage parlors, and the notice made under Government Code section 66018 will have been unnecessary. -2- EXHIBIT A The fees charged for processing applications, making investigations , and issuing permits, as authorized by county ordinances, shall be as follows : Bingo (See Pen. Rupf, Assistant I' = I Captain Russell itlrin, Commander invesngcuw., division Subject Cardroom Information The question arose as to how many counties allow cardrooms in the unincorporated area of the.county. The Department of Justice was contacted and have ascertained that 23 counties allow cardrooms in the unincorporated area. The following observations have been made: 1. The large metropolitan areas, such as San Francisco, Santa Clara, Los Angeles, Orange County, and San Diego County all prohibit cardrooms in the unincorporated area of the county. 2. The entire greater Bay Area, ten counties, all prohibit cardrooms, with the exception of Contra Costa County. 3. Of the 23 counties allowing cardrooms in the unincorporated areas, they mostly seem to be the small mountain area, Northern California, or desert counties. 4. For the purpose of comparison, we have used some of the more active cities and counties involved in card-ooms. Counties Allowing Cardrooms in the Unincorporated Areas Butte Colusa Contra Costa El Dorado Imperial Kern Lake Merced Modoc Monterrey Napa Placer Sacramento San Luis Obispo Santa Cruz Shasta Sierra Sonoma Stanislaus Tehama Tulare Tuolumne Yuba NOTES: Large metropolitan areas, such as Los Angeles, San Diego, San Francisco, Santa Clara, Orange all prohibit crdrooms in the unincorporated area. The entire greater Bay Area Counties prohibit cardrooms in the unincorporated area, with the exception of Contra Costa. Almost all the above Counties are small, sparsely populated Counties in the Northern California, along the Sierras, and the desert areas of California. The vast majority of crdrooms are issued within cities, rather than within the unincorporated areas of counties. Non-refundable 5.5$, of .the quarterly gross receipts and $1000 per table, per quarter. $100 Cardroom Employee Permit Fee - initial only. $ 15 Cardroom Employee Permit transfer fee $ 20 Cardroom Employee permit (Annual renewal or replacement of lost card) . 5 Minimum, tables 22 Maximum tables, (except the Oaks Club has 27 tables) • License approved by Council 3. City of $40,000 Application Fees. $20,000.00 Bell Gardens per quarter thereafter. None Annual Renewal Fees 8.2%-13.2% It started from 8.2$ to 13.2% of the total monthly gross receipts. (Please see attached chart Page 108) . None Table Fees 35 Minimum tables License approval by Council 4. City of $125 Application fees plus $1,000 Sacramento. Surety Bond. None Annual Renewal Fees. .00045 Of Gross Receipts with $3,000 CAP Paid Annually. $60 Cardroom Employee Badge. Renewal Fees $15.00. None Table Fees License approved by City Manager. 5. City of Bell $18,750 Application fees, per quarter 7% to 13% It started from 74 to 13% of the total monthly gross receipts. (Please see attached chart - Page 178- 179) . None Table fees None Annual Renewal Fees 30 Cardroom Employee Badges. One-time processing. No renewal required. None Minimum Tables License approved by City Council. 6. City of Gardena $30,000 Application Fees. Covers fist and second quarter. None Annual Renewal Fees 7.5% - 15.5% It started from 7.5% to 15.5% of the total monthly gross receipts. (Please see attached Chart) . None Cardroom Employee Badges. Required at no charge. None Table Fees 20 Minimum Tables 35 Maximum Tables License approved by Council. 7. Contra Costa $500 Application fees, Non- County Refundable. $500 Annual Renewal Fees, Non- Refundable $500 Per table yearly $100 Cardroom Employee Badges, plus Fingerprint Fee, Permit $25 Renewal Employee Permit $20 Tables License approved by Board of Supervisors Our Cardroom Fees have not been increased since at least August, 1982. Some fees have not been increased since 1976. Some jurisdictions have lower fees and are not listed herein.
