SUBJECT: REZONING - Paul Chahin (Applicant) - Gene Dolan (Owner) - 2957-RZ
to rezone 4.5 acres from R-6 and R-B to Planned Unit Development
District (P-1) , Development Plan #3015-91 and Subdivision #7661,
in the Pinole Area. (S.D. )
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Approve rezoning application 2957-RZ, Paul Chahin (Applicant) ,
Gene Dolan (Owner) , to rezone 4 . 5 acres from Single Family
Residential District (R-6) and Retail Business District (R-B)
to Planned Unit District (P-1) , as recommended by the County
Planning Commission on Tuesday,. September 24 , 1991.
2 . Approve Development Plan #3015-91 with conditions as
recommended by the County Planning Commission.
3 . Approve the tentative map for Subdivision #7661 as recommend-
by the County Planning Commission.
4 . Adopt the County Planning Commission's findings as set forth
in its Resolution No. 38-1991, as the basis for your Board's
decision
5. Accept the environmental review documentation being
adequate.

ADDENDUM
On November 19, 1991, the Board of Supervisor closed the
hearing and deferred to this date the decision on the request of
Paul Chahin and Gene Dolan for approval of rezoning application
2957-RZ, Final Development Plan 3015-91 and tentative map for
Subdivision 7661 in the Pinole area.
Dennis Barry, Community Development Department, presented.
the staff report and advised of an addition to the staff
recommendations that are listed that the Board introduce the
ordinance for the rezoning, waive reading, and set September 10,
1991 for adoption.
Supervisor Powers advised that Supervisor Fanden had stepped
from the chambers, and of a request to speak from an adjoining
property owner.
The Board discussed the issue of receiving testimony or re-
noticing the hearing, and discussed the circulation issue from
the last meeting.
Paul Chahin, applicant, advised that he would prefer not to
have another public hearing.
Supervisor Schroder moved the rezoning and the
recommendations with the accesses in the original plan.
Supervisor Powers seconded the motion.
Supervisor Torlakson advised he would like to have testimony
from the property owner requesting to testify or he could not
support the motion.
Supervisor Powers commented in favor of putting the roads
through.
Mr. Chahin commented that there has been ample notice given
for hearings and that he has tried to address all concerns .
The vote on the motion was as follows :
AYES : Supervisors. Schroder and Powers
NOES : None
ABSENT: Supervisor Fanden
ABSTAIN: None
Supervisor McPeak expressed a preference to continue the
matter until Supervisor Fanden returned.
Upon her return to the Chambers, Supervisor Fanden requested
clarification on whether the matter had been worked out with the
Public Works Department and the applicant .
The applicant responded on issues including a community
meeting in the mobile home park, not developing the two sites
jointly, and not holding a public hearing.
Supervisor Powers clarified that this was a matter for
decision or should be opened up for public testimony, and he
indicated a preference for making a decision today.
Supervisor Fanden requested clarification on the resolution
of the issue of the closure of a street .
Mitch Avalon advised that staff had reviewed an alternate
plan showing the streets being cul de sacd but that staff favored
the plan approved by the Planning Commission not cul de sacing
the streets .
Supervisor Fanden moved to approve the staff
recommendations .
Supervisor Schroder seconded the motion.
IT IS BY THE BOARD ORDERED that recommendations 1, 2, 3 , 4 , and
5 are APPROVED and Ordinance No. 91-55 is INTRODUCED, giving
effect to the rezoning, reading waived, and September 10 , 1991 ,
is SET for adoption of same.
