MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: December 3, 1991 SUBJECT: Termination of the East/Central County Travel Corridor Area of Benefit. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: t DECLARE that the County's obligation for the interim project funded by the East/Central County Travel Corridor'(ECCTC) Area of Benefit has been met. DIRECT the Public Works Director to arrange for the termination of collecting the East/Central County Area of Benefit fee. REFER to the Transportation Committee the issue of allocating the unobligated balance in the ECCTC Area of Benefit trust account (Fund 8189). II. Financial Impact: None. The County's obligation for interim project has been met with the collection of the ECCTC Area of Benefit fees. III. Reasons for Recommendations and Background: In August 18, 1987 the Board of Supervisors approved the ECCTC Area of Benefit fee to finance safety and capacity improvements of the travel corridor between Willow Pass Road in the City of Concord and Willow Pass Road in West Pittsburg. On September 9, 1989 the Board of Supervisors approved a contract with Bay Cities Paving and Grading Inc. to construct a third lane in the westbound direction and to relocate the westbound on-ramp from Willow Pass Road in West Pittsburg. Reasons for Recommendation and Background: (Cont.) On January 23, 1990 the Board of Supervisors accepted the contract as complete. The collection of ECCTC Area of Benefit fees has continued to provide for payment of the Bonds that were issued to finance the improvements. The final bond payment has been made and the Bank Trust Account was closed November 7, 1991. Therefore, the termination clause in the ECCTC Development Report has been met and the ECCTC Area of Benefit fee should be terminated. IV. Consequences of Negative Action: (Cont.) ECCTC Area of Benefit fees will continue to be collected in violation of the terms of the Development Report approved by the Board of Supervisors. cc: V. Alexeeff, GMEDA Director H.
