MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: December 3, 1991 SUBJECT: Reimbursement to Dame Construction Company for work performed on Camino Tassajara in the Danville area. (Payment No. 2) Project No.: 0662-6R4162 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: Authorize the Public Works Director to arrange with the Auditor's Office to pay Dame Construction Company reimbursement payment No. 2 in the amount of$142,110.87. This is for work performed on Camino Tassajara in realigning the Bettencourt curve as identified on the project list of the Joint Exercise of Powers Agreement between the Town of Danville, the City of San Ramon and Contra Costa County. II. Financial Impact: None to the General Fund. The reimbursement will be made with fees collected from development in the Tassajara area, specifically for this project. Sufficient developer fees have been collected pursuant to the Joint Exercise of Powers Agreement to cover this reimbursement payment. 111. Reasons for Recommendations and Background: In 1987 the Town of Danville, the City of San Ramon and Contra Costa County entered into a Joint Exercise of Powers Agreement(JEPA) entitled"Tassajara Area Transportation Improvement Fees". The JEPA established fees that would be charged for certain properties developing within the Tassajara area. The fees would fund improvements in the Town, the City and the County to mitigate the traffic impacts from these developing properties. One of the properties identified in the JEPA was the Bettencourt ranch. The Bettencourt ranch was originally proposed for development by Braddack and Logan and was subsequently purchased by Dame Construction Company, who has actually followed through with the construction of the project. Reasons for Recommendations and Background cont.: One of the projects listed in the project report of the JEPA was the realignment of the curve on Camino Tassajara along the frontage of the Bettencourt Ranch. Initially, the County was to design and construct the realignment of Camino Tassajara. However, the developers felt they could perform the improvement on a time line that would better suit the development of their projects, and proposed to perform the realignment of the road as part of their subdivision development. The County concurred, and as a result, Dame Construction Company constructed the realignment of the road in addition to some major drainage facilities for the Flood Control District. This reimbursement represents the second installment payment covering several major items of work that are complete. There will be additional payments once the other outstanding items of work are accepted as complete. IV. Consequences of Negative Action: Dame Construction Company would not be paid for the work they have done for Contra Costa County.
