THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on December 17, 1991 by the following vote:
AYES: Supervisors Fanden, Schroder, Torlakson and McPeak
NOES: None
ABSENT: Supervisor Powers
ABSTAIN: None

SUBJECT: Proposed Villanova Drive Boundary Change Between Alameda and
Contra Costa Counties
The Board on November 5, 1991 fixed this time for hearing
the proposed Villanova Drive Boundary Change between Alameda and.
Contra Costa Counties.
Jim Cutler, Community Development Department, reviewed the
proposed change and explained that it involved about two acres of
developable land which would be put into Alameda County and would
place some East Bay Regional Park district Land which is in Alameda
County in Contra Costa County.
Mr. Cutler advised that the staffs of the three
jurisdictions plus the Local Agency Formation Commissions of the two
counties have met and conferred and have come to the consensus that
the request for this boundary change is a reasonable one.
The Chair declared the hearing open and the following
persons appeared to speak:
Mr. Richard H. James, 1118 Glengarry Drive, Walnut Creek,
advised that he had filed the petition for boundary change to enable
him to build on his lot by enabling him to access the Oakland City
Sewer System, and it will place property that is serviced by the
Oakland Fire and Police and other services in Oakland.
Charles Steidtmann, 7755 Skyline Boulevard, Oakland, advised
that his family owns lots 1291 and 1292 located in Contra Costa County
on Villanova Drive and surrounded by the area which is the subject of
the proposal before the Board. He expressed concern that his property
value would be destroyed by this boundary change in that his property
would no longer be contiguous with the county line and therefore
preclude his ever being allowed to annex to Alameda County and
Oakland. He urged the Board not to change the boundaries, or, if Mr.
James ' lots are annexed to Alameda County, that the Park District land
currently in Alameda County not be brought into Contra Costa County.
Victor J. Westman, County Counsel, advised the Board that
once it initiates proceedings, as it has done on this matter, the
Board has no discretion under the law to modify the boundaries, and
that if the Board wished to consider a modified proposal, it would
have to adopt another resolution initiating proceedings and set
another date for hearing.
Supervisor Fanden noted that she was inclined to support Mr.
Steidtmann' s proposal and inquired about the cost and time to renotice
the hearing with amended boundaries.
Mr. James urged the Board to move forward with his petition,
citing the time, effort and cost involved to date.
Chairman McPeak noted that the Board had received a letter
from Harold L. Beals, 590 Creekside, Pleasant Hill, CA 94523 ,
requesting postponement of the hearing on the proposed boundary
change.
Mr. Beals appeared and advised the he owns a piece of
property off Winding Way just a little off Villanova Drive in Contra
Costa County, and that there are 3 or 4 other lots involved, all of
whom would like to annex to Alameda County in the future so they have
access to electricity, sewerage and so on.
Chairman McPeak inquired if staff had met with all of the
property owners. Mr. Cutler responded that they had met only with the
petitioner.
Chairman McPeak suggested that staff meet with all the
property owners and then give the Board the information on what they
see as the pros and cons and what are some of the options, and then if
it appears necessary, the Board could proceed with renoticing a new
hearing.
IT IS BY THE BOARD ORDERED that the Community Development
staff is directed to meet with all the interested property owners and
return to the Board with a report and recommendations on whether the
Board should initiate a modification to the proposed boundary change.
IT IS FURTHER ORDERED THAT this matter is continued to January 21,
1992 at 2: 00 p.m.
