HomeMy WebLinkAboutMINUTES - 12171991 - D.1 D. 1 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUN'T'Y, CALIFORNIA Adopted this Order on December 17, 1991 by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson, Powers NOES: None ABSENT: None ABSTAIN: None SUBJECT: Renewal of Card Room License The Board on December 10, 1991, deferred to this day decision on the application of Mr, and Mrs. Ray Stetler for renewal of. Card Room ' License No. 3 , known as "Shorty'.s Bar and Patio," located at 2396 Pacheco Boulevard, Pacheco. The Board received a. memorandum dated December 13 , 1991, from Captain R. F. Pitkin, Investigation Division Commander, advising of the results of a meeting on December 12, 1991 , attended- by concerned citizens complaining of the noise from Shorty' s cardroom. A copy of that memorandum is attached and included as a part of this Board Order. Also attached is the recommendation of the Sheriff. Mr. Max Ramsay, 1351 Potter Street, Martinez 94553 , expressed concern that the conditions under which the card room license is to operate may not be met, and therefore submitted a proposed resolution for neighborhood nuisance control. He requested the Board to review Sections 370 - 373 of the State Penal Code. Supervisor McPeak commented on the similarity of the proposed resolution .to the recently enacted Juvenile Gatherings Ordinance (No. 91-51) . She suggested that County Counsel review the. feasibility of amending Ordinance No. 91-51 to provide for the broadening of its application and imposition of fees for reimbursement of relevant Sheriff 's services. On recommendation of Supervisor Fanden, IT IS BY THE BOARD ORDERED that the application of Mr. and Mrs. Ray Stetler for renewal of Card Room License No. 3 (known as "Shorty' s Bar and Patio" ) subject to the terms and conditions as set forth in the attached recommendation submitted by the Sheriff is APPROVED. As recommended by Supervisor Fanden, IT IS FURTHER ORDERED that the proposed resolution is REFERRED to the Sheriff and—County Counsel for review and possible amendment of County Ordinance No. 91-51. RAINEY, SHERIFF-CORONER Costa DATE; December 13, 1991 County SUBJECT: RENEWAL OF CARD ROOM LICENSE (Revised 12/13/91) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Approve renewal of Card Room License No. 3, known as "Shorty's Bar and Patio", located at 2396 Pacheco Boulevard, Pacheco, California, for the period of 19 December 1991 through 19 December 1992, with the conditions as follows: Will not allow live music to be played past 10:00 p.m. The only exceptions would b , the Fourth of July, and the Saturday preceding the 19th of October (annually) where live music will be no later than 12:30 a.m. BACKGROUND AND JUSTIFICATION An application was submitted by Mr. and Mrs. Ray Stetler for renewal of Card Room License No. 3, known as "Shorty's Bar and Patio". Reference County Ordinance No. 82-44, Chapter 52-3, Article 1, Para. 52-3.321. The Sheriff has conducted the usual background investigation and, as a result of this investigation, this office finds no detrimental information that would preclude approval of said application. However, due to complaints or questions which have been raised regarding activities at this location, the Board may wish to set this matter for a hearing. A meeting which was directed by the Board was held on December 12, 1991, with a citizen group. It was agreed to substitute New Year's Eve with "the Saturday preceding October 19th, annually. Correspondence and other documents relevant to this application are attached for consideration by the Board. FINANCIAL IMPLICATION The County collects $500.00 application fee and $500.00 license fee for one (1) table. The meeting was held on 12/12/91. The citizens group stated they, "did not want to hinder" the cardroom license, but wanted: 1. The 10 p.m. curfew honored. 2. To submit a written statement to the Board that they referred to as a resolution. Mr. Stetler stated he is not inclined to play live music often and that he would rather have the 12:30 time limit on his anniversary rather than on New Year's Eve. A consensus was reached by all parties on the following: Eliminate New Year's Eve from the cardroom license. Add "the Saturday preceding October 19" annually to the cardroom license. The citizens' statement would be forwarded to the Board if provided to this office by Monday, December 16, 1991. The Sheriff would not be involved with the written statement, (called their resolution). If it is not ready by December 16, 1991, the citizen group would submit their statement to Supervisor Fanden. The citizen group agreed to report and insist that a crime report be written if future violations are noted. ACTION TAKEN 1. A revised Board Resolution deleting New Year's Eve and adding the October Saturday is hereby submitted. 2. The citizen group will submit their statement (referred as a resolution) to the Board. RFP:rk
