HomeMy WebLinkAboutMINUTES - 12171991 - 1.19 THE BOARD OF SUPERVISORS, AS THE GOVERNING BODY OF THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT Adopted this Resolution on December 17, 1991, by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson and Powers NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 91/ 819 Government Code § 25526.6 SUBJECT: Conveyance of Easement to the City of Walnut Creek San Ramon Creek north of Rudgear Road Project No. 4585-6G5575 Walnut Creek Area The Board of Supervisors, as the governing Body of the Contra Costa County Flood Control and Water Conservation District RESOLVES THAT: The District acquired certain real property by deed recorded on December 20, 1967, in Book 5520 at page 451, located in the City of Walnut Creek, for San Ramon Creek Channel. The City of Walnut Creek has requested an easement over a portion of said property, described in Exhibit "A" attached hereto, for construction of a bridge for the South Broadway extension. This Board FINDS that the conveyance of such easement is in the public interest and will not substantially conflict or interfere with the District's use of the property. This Board hereby APPROVES and AUTHORIZES the conveyance of an easement to the City of Walnut Creek, over the property described in Exhibit "A" attached hereto, pursuant to Government Code Section 25526.6 and the Board Chair is hereby ,AUTHORIZED to execute an easement on behalf of the District in consideration for the payment received in full in the amount of $2,500. The Real Property Division is DIRECTED to cause said Grant of Easement to be delivered to the grantee. This conveyance request is part of a larger project for which an Environmental Impact Report was prepared by the City of Walnut Creek and certified as complete. This activity has been found to conform to the General Plan of the City of Walnut Creek. Commencing at standard Contra Costa County monument RR-1 at Rudgear Road and Danville Boulevard; thence north 430 48' 41" east 714.61 feet to standard Contra Costa County monument RR-2 at Rudgear Road and Bishop Lane; thence south 500 58' 07" west 324.31 feet to the true point of beginning of the subject property, being the most southwesterly corner of said Parcel 13 (5520 O.R. 451); thence along the west line of Parcel 13 north 260 50' 21" west 26.74 feet; thence north 430 03' 52" east 20.18 feet to the beginning of a tangent curve concave westerly having a radius of 28.00 feet; thence northeasterly and northerly along said curve through a central angle of 65° 15' 11" an arc distance of 31.89 feet; thence tangent to said curve, north 220 11' 19" west, 52.89 feet to the northwest line of Parcel 13 (5520 O.R. 451); thence along said northwest line 480 37' 03" east 128.21 feet; thence south 220 11' 19" east 37.72 feet to the beginning of a non- tangent curve concave northerly having a radius of 40.00 feet, a radial line bears north 300 33' 08" east; thence southeasterly, easterly, and northeasterly along said curve through a central angle of 740 39' 30" an arc distance of 52.13 feet; thence tangent to said curve, north 450 53' 38" east 47.70 feet to the beginning of a tangent curve concave westerly having a radius of 15.00 feet; thence northeasterly, northerly, and northwesterly along said curve through a central angle of 920 04' 57" an arc distance of 24.11 feet to the northeast line of Parcel 13 (5520 O.R. 451); thence along the boundary of Parcel 13 as follows: (1) back tangent to said curve south 460 11' 19" east 12.67 feet to the beginning. of a tangent curve concave westerly having a radius of 15.00 feet; (2) southeasterly, southerly, and southwesterly along said curve through a central angle of 900 00' 00" an arc distance of 23.58 feet, and (3) tangent to said curve south 430 48' 41" west 273.88 feet to the true point of beginning.
