SUBJECT: Small Water Systems Regulation AB2158 "�ll�r
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Approve the proposal of the Health Officer to enforce applicable provisions of AB
2158, and the State Drinking Water Act and Chapter 15, Title 22, California Code of
Regulations to small water systems of 15-199 connections in Contra Costa County.
2. Notify the Office of Drinking Water, State Department of Health Services of the
County's intent to contract with the State for enforcement of AB 2158 in Contra Costa
County.
3. Direct the Health Officer to proceed with personnel actions to add the two new
Environmental Health Specialist positions required to conduct the program.
BACKGROUND AND JUSTIFICATION:
AB 2158 became law on January 1, 1991 and transferred responsibility for the regulation of
small water systems to the State Department of Health Services, effective July 1, 1992. AB
2158 also provides that the Department of Health Services may, upon mutual agreement,
contract with a local health agency to conduct the regulatory program. The new
requirements of the Federal & State Drinking Water Program have mandated increased
regulation and monitoring of small water systems. The intent of these laws is to upgrade and
provide safe drinking water for residents served by small water systems.
FINANCIAL IMPACT:
None. Existing program is supported by a Public Health License Fee system. Costs of the
new program will be reimbursed by the Office of Drinking Water and will not be charged to
the General Fund.
